Bombay Highways Act, 1955, (Maharashtra) Section 19B

Title: Determination of Amount Payable as Compensation

.....the Bombay Highways Act, 1955, on the lines of the amendment to the National Highway Act, 1956 carried out by the Government of India by the National Highways Laws (Amendment) Act, 1997. The main impediment in the speedy implementation of the Highways projects has been the inordinate delay in the acquisition of land under the existing provisions of the Land Acquisition Act, 1894. In order to remove this procedural delay and the delays resulting from litigation and to expedite the process of land acquisition, it is proposed that once the State Government declares that the land is required for the public purpose for construction or for development of a highway, that land will vest in the Government and such declaration cannot be challenged in a Court, and only the amount by way of compensation will have to be paid, and any dispute relating to compensation will be subject to adjudication through the process of arbitration only.- [Mah.
