Animal Disease (Control) Act, 1961 Chapter 2

Title: Prevention and Control of Contagious or Infectious Diseases

Section 9 - Power of State Government to declare infected area (1) On receipt of the report of the Veterinary Officer, under sub-section (3) of section 7 or sub-section (2) of section 8 the prescribed authority shall, after making such further enquiry, as it thinks fit, submit such report with its remarks thereon, if any, to the State Government, which may- (a) confirm any declaration made under sections 7 (1), 7 (3) or 8 (1) either with or without modifications; or (b) cancel any such declaration. (2) ( a ) Where the State Government confirms any such declaration, either with or without modifications, it shall by notification, define the limits of the area to which the declaration with modifications, if any, made therein, shall apply and declare such area to be infected area; (b) the State Government may by notification add, amend, vary or rescind any notification published under clause (a) either on its own motion or on a further report of a Veterinary Officer, submitted through the prescribed authority; (c) on the publication of a notification under clause (a) or (b) any place declared by the Inspector or the Veterinary Officer to be an infected.....

Title: Duty of Certain Persons to Report Contagious or Infectious Diseases

Every owner or person in charge or having control of an animal, and every Veterinary Practitioner who has been called upon to treat an animal, which he has reason to believe to be infected with contagious or infectious disease, shall forthwith report the fact to the Inspector having jurisdiction in the area.

.....reason to believe that any person whom he has visited in his professional capacity in any dwelling not being a hospital, or that every manager of anyfactory or educational institution, or every head of a household, who knows or has reason to believe that any person who resides in any dwelling under the management or control of any such manager or head of a household, is suffering from any illness which may reasonably be supposed to be a infectious disease, shall give information of the same with the least practicable delay to such person as may be designated by the municipal council in that behalf; (b) power to direct or authorise the inspection without notice or with such notice as to the person directed or authorised to inspect appears reasonable of any place in which any infectious disease is reported or suspected to exist and the taking of measures to prevent the spread of the disease beyond such place; (c) power to prohibit the removal of water for the purpose of drinking from any well, tank or other place, which may appear to the municipal council, on the advice of the medical officer, likely to endanger or cause the spread of any infectious disease; (d) power to.....

Title: Duties of Municipal Council on Threatened or Actual Outbreak of Infectious Disease

.....by the municipal council no claim for compensation shall lie for any loss or damage caused by any exercise of the powers specified therein. (5) If in any 1 [municipal area] in which such declaration under sub-section (2), as aforesaid is for the time being in force, any person, -- (a) knowingly disobeys any order which for the time being is in force in such 1 [municipal area] and which has been passed by the municipal council in exercise of any power conferred on it by section 248 or under this section, or (b) obstructs any officer of the municipal council or other person acting under the authority of the municipal council in carrying out or executing any such order, such person shall be punishable with fine which may extend to one thousand rupees. _______________________________ 1. Manipur Municipalities Act, 1994 Section 177

Title: Removal to Hospital of Patient Suffering from Infectious Disease

In any municipality when any person suffering from any infectious disease is found to be-- (a) without proper lodging or accommodation, or (b) living in a Serai or other public hostel, or (c) living in a room or house which neither he nor any one, of whom he is a dependent, either own or pays rent for, the Nagar Panchayat or, as the case may be the Council, by any persons authorised by it in this behalf may, on the advice of an Assistant Surgeon, remove the patient to any hospital or place at which persons suffering from such diseases are received for medical treatment and may do anything necessary for such removal.

Title: Owner or Occupier to Take Steps to Prevent Spread of Infectious Disease

In the event of a municipality, or any part thereof, being visited with an outbreak of cholera or other infectious disease notified in this behalf, the owner or occupier may during the continuance of the epidemic, without notice and at any time, inspect and disinfect any well, tank or other place from which water, is or is likely to be taken for the purpose of drinking and may further take such step as he deems fit to prevent the removal of water therefrom.

Title: Power of Entry into Building, Etc., Where Infectious Disease Exists

The Secretary or any person authorised by the Grama Panchayat in this behalf may enter at any time after reasonable notice, any building or premises in which any infectious disease is reported or suspected to exist, for the purpose of inspecting such building or premises.
