Information Technology Act, 2000 Section 70B

Title: Indian Computer Emergency Response Team to Serve as National Agency for Incident Response

(5) The manner of performing functions and duties of the agency referred to in sub-section (1) shall be such as may be prescribed. (6) For carrying out the provisions of sub-section (4), the agency referred to in sub-section (1) may call for information and give direction to the service providers, intermediaries, data centres, body corporate and any other person. (7) Any service provider, intermediaries, data centres, body corporate or person who fails to provide the information called for or comply with the direction under subsection (6), shall be punishable with imprisonment for a term which may extend to one year or with fine which may extend to one lakh rupees or with both. Railways Act, 1989 Section 124A

Title: Compensation on Account of Untoward Incident

.....only for loss occasioned by the death of, or injury to, a passenger as a result of such untoward incident: Provided that no compensation shall be payable under this section by the railway administration if the passenger dies or suffers injury due to-- (a) suicide or attempted suicide by him; (b) self-inflicted injury; (c) his own criminal act; (d) any act committed by him in a state of intoxication or insanity; (e) any natural cause or disease or medical or surgical treatment unless such treatment becomes necessary due to injury caused by the said untoward incident. Explanation. --For the purposes of this section, "passenger" includes-- (i) a railway servant on duty; and (ii) a person who has purchased a valid ticket for travelling by a train carrying passengers, on any date or a valid platform ticket and becomes a victim of an untoward incident.] ______________________ 1. Indian Easements Act, 1882 Chapter 3

Title: The Incidents of Easements

Section 30 - Partition of dominant heritage Where a dominant heritage is divided between two or more persons, the easement becomes annexed to each of the shares, but not so as to increase substantially the burden on the servient heritage: Provided that such annexation is consistent with the terms of the instrument, decree or revenue proceeding (if any) under which the division was made, and in the case of prescriptive rights, with the user during the prescriptive period. Bombay Inferior Village Watans Abolition Act, 1958, (Maharashtra) Section 4

Title: Abolition of Inferior Village Watans Together with Incidents Thereof

.....to the provisions of sections 5, 6 and 9 all watan land shall be and is hereby resumed and shall be subject to the payment of land revenue under the provisions of the Code and the rules made thereunder as if it were an unalienated land : Provided that, such resumption shall not affect the validity of any alienation of such watan land made in accordance with the provisions of the existing watan law or the rights of an alienee thereof or any person claiming under or through him. NOTES It provides for the abolition of all inferior village watans and the extinguishment of all incidents appertaining to the said watans. It also provides for the resumption of all watan lands and makes such land liable to the payment of land revenue under the provisions of the Code. Who can be made parties to suit for injunction.-Inam lands regranted to the plaintiff on payment of occupation charges. There was allotment of such lands to defendants by the orders of Tahsildar. Since the Tahsildar had no authority to allot the land, Tahsildar and the Government were not necessary parties to the injunction suit.- Nimba Bhuta Koli v. Barku Zamarya Bhil, 1986 (1) Bom. C. Transfer of Property Act, 1882 Section 2

Title: Repeal of Acts-saving of Certain Enactments, Incidents, Rights, Liabilities, Etc.

In the territories to which this Act extends for the time being the enactments specified in the schedule hereto annexed shall be repealed to the extent therein mentioned. But nothing herein contained shall be deemed to affect- (a) the provisions of any enactment not hereby expressly repealed: (b) any terms or incidents of any contract or constitution of property which are consistent with the provisions of this Act, and are allowed by the law for the time being in force; (c) any right or liability arising out of a legal relation constituted before this Act comes into force, or any relief in respect of any such right or liability; or (d) save as provided by section 57 and Chapter IV of this Act, any transfer by operation of law or by, or in execution of, a decree or order of a Court of competent jurisdiction; and nothing in the second chapter of this Act shall be deemed to affect any rule of1[ * * * * *] Muhammadan2[ * * * * *] law. ________________________ 1. Karnataka] Village Offices Abolition Act, 1961 Section 4

Title: Abolition of Village Offices Together with Incidents Thereof

State: Karnataka

Notwithstanding anything in any usage, custom, settlement, grant, agreement, sanad, or in any decree or order of a Court, or in an existing law relating to village offices, with effect on and from the appointed date,-- (1) all village offices shall be and are hereby abolished; (2) all incidents (including the right to hold office and the emoluments attached thereto, the right to levy customary fees or prequisites in money or in kind and the liability to render service) appertaining to the said village offices shall be and are hereby extinguished; (3) subject to the provisions of section 5, section 6 and section 7, all land granted or continued in respect of or annexed to a village office by the State shall be and is hereby resumed, and shall be subject to the payment of land revenue under the provisions of the Code and the rules and orders made thereunder as if it were an unalienated land or ryotwari land.

Title: Abolition of Certain Watans Together with the Right to Office and Incidents

With effect from and on the appointed day, notwithstanding anything contained in any law, usage, settlement, grant, sanad or order - (1) all Paragana and Kulkarni watans shall be deemed to have been abolished; (2) all rights to hold office and any liability to render service appertaining to the said watans are hereby extinguished; (3) subject to the provisions of section 4, all watan land is hereby resumed and shall be deemed to be subject to the payment of land revenue under the provisions of the Code and the rules made thereunder as if it were an unalienated land: Provided that, such resumption shall not affect the validity of any alienation such watan land made in accordance with the provisions of section 5 of the Watan Act or the rights of an alienee thereof or any person claiming under or through him; (4) all incidents appertaining to the said watans are hereby extinguished.
