Mental Health Act, 1987 Section 66

Title: Proceeding if Accuracy of Inventory or Accounts is Impugned

If any relative of the mentally ill person or the Collector impugns, by a petition to the District Court, the accuracy of the inventory or statement referred to in sub-section (1) or, as the case may be, any annual account referred to in sub-section (2), of section 60, the Court may summon the manager and summarily inquire into the matter and make such order thereon as it thinks fit: Provided that the District Court may, in its discretion, refer such petition to any Court subordinate to it, or to the Collector in any case where the manager was appointed by the Collector and the petition is not presented by the Collector.

In the context in which clause (a) appears in section 2(5) and in view of the fact that there is a comma after the words "sites of buildings" we are of the view that the words "sites" in clause (a) does not qualify the words "other structures on such land" It should be interpreted as including other structures on such land as also sites of buildings. The Assam Cooperative Societies Act, 1949 Complete Act

.....Corporation Limited v. Collector of Central Excise [AIR 1963 SC 104], was concerned with the question as to whether exemption of excise duty to the factory run by a Co-operative Society, when exempted on payment of such duty was discriminatory or not. Their Lordships held that such exemption does not fall under discrimination. Similar question also arose in the cases of P.V. Shivarajan v. The Union of India [1959 Supp (1) SCR 779] and Gordhandas v. Assistant Collector of Central Excise and Customs. [(Unreported, decided on 27-9-68 in CA No. 1040 of 1965]. CHAPTER 1 Preliminary 1. Short title, extent and commencement. (1) This Act may be called the Assam Co-operative Societies Act, 1949. (2) It extends to the whole of the State of Assam. (3) It shall come into force on such date as the State Government may appoint. COMMENTS The Act came into force from 1st April, 1950, vide Notification No. CG 6/50/ 40, dated 3-3-1950. 2. Definitions. In this Act, unless there is anything repugnant in the subject or context " (a) "Administrative Council" means a body intermediary between a Managing Body and the General Assembly of registered society: "Affiliating Society".....

The Rajasthan Irrigation and Drainage Act, 1954 Complete Act

.....have not specifically stated in which Chak their land is situated but as alleged by respondents their pertains to chak No.5 & 6. This fact is not disputed. Under the circumstances, the petitioners have not been able to satisfy that by creating a new chak 6 MSR-A and allowing the applicants to take water supply for irrigation, the water course from which the petitioners are being given water supply for irrigation is reduced. The land in dispute was not irrigated through outlet of chak No. 26-A/A or any other chak including the chaks of the petitioners but by a fresh outlet in which case obviously section 16 will apply and the question of completing formalities u/s.20 of the Act does not arise. Apart from that, it is settled that opinion of expert in field is to be ordinarily accepted to be correct in the absence of there being any allegation of mala fide and the authorities having specialised knowledge about the functioning of irrigation are free to ensure proper, equitable distribution of flow of water in the interest of all concerned. Title: Judicial Inquisition Regarding Alleged Mentally Ill Person Possessing Property,custody of His Person and Management of His Property

Lunacy Act, 1912 Complete Act

.....(2) If either of the medical certificates any relatives, partner or assistant of the lunatic or of the petitioner the petition shall state the fact and where the person signing is a relative the exact manner in which he is related to the lunatic or petitioner. (3) The petition shall also state whether any previous application has been presented for an inquiry into the mental capacity of the alleged lunatic in any Court; and if such application has been made, a certified copy of the order made thereon shall be attached to the petition (4) No application for a reception order shall be entertained in any area outside the Presidency-towns unless the State Government has, by notification in the Official Gazette declared such area as an areas in which reception orders may be made".
