THE PUBLIC EMPLOYMENT (REQUIREMENT AS TO RESIDENCE) AMENDMENT ACT,1969 [Act, No. 1 of 1969] [19th March, 1969] PREAMBLE An Act further to amend the Public Employment (Requirement as to Residence) Act, 1957. BE it enacted by Parliament in the Twentieth Year of the Republic of India as follows:-- 1. Short title.- This Act may be called the Public Employment (Requirement as to residence) Amendment Act, 1969. 2. Amendment of section 3.- In section 3 of the Public Employment (Requirement as to residence) Act, 1957 (44 of 1957) (hereinafter referred to as the principal Act),-- (i) in sub-section (1), inclause (c) , for the words "local authority", the words "local or other authority" shall be substituted; (ii) insub-section (2), clause (a) shall be re-lettered as clause (aa) and before clause (aa) as so re-lettered, the following clause shall be inserted, namely:-- (a) "Himachal Pradesh" includes the territories specified in sub-section (1) of section 5 of the Punjab Reorganisation Act, 1966 (11 of 1966);. 3. Amendment of section 5.- Insection5of the principal Act, for the words "ten years, the words "fifteen years" shall be substituted.

Title: Repeal of Existing Laws Prescribing Requirements as to Residence

Upon the commencement of this Act, any law then in force in any State or Union territory by virtue of clause (b) of article 35 of the Constitution prescribing, in regard to a class or classes of employment or appointment to an office under the Government of, or any local or other authority within, that State or Union territory, any requirement as to residence therein prior to such employment or appointment shall cease to have effect and is hereby repealed.

.....to the Authority that he or any of its directors or any of its partners, as the case may be, has (i) not contravened any of the provisions of the Act or the IRDA Act, or any rules or regulations made under those Acts or any order or direction issued by the Authority; (ii) not made a statement which is false in material particulars with regard to his eligibility for the licence or renewal thereof or in any of the activities transacted by him or them or the matters connected therewith as a surveyor and loss assessor; (iii) neither had his licence cancelled or suspended under the Act, nor had violated the Code of Conduct prescribed under these regulations; (iv) discharged the duties and responsibilities as a professional; (v) not been negligent in the discharge of his obligations; and (vi) not been sentenced to a term of imprisonment by any Court of law. Regulation 8 Procedure where licence is not to be granted or renewed, or where licence is to be suspended or cancelled (1) Where an applicant does not satisfy the provisions of the Act and these regulations, the Authority may reject the application for grant of licence or renewal thereof and refund to the applicant not more.....

.....with regard to requirements as to residence for purposes of any employment or appointment under the State, any local or other authority, but section 3of the Act empowered the Central Government to make rules prescribing requirements as to residence within Telangana area of Andhra Pradesh or the Union territories of Himachal Pradesh, Manipur or Tripura for appointments in subordinate services. Section 5 of the Act fixed a period of five years from the commencement of the Act during which the domicile rules framed under section 3in respect of the abovementioned areas were to remain in force. Since the Act came into force on the 21st March, 1959, the domicile rules framed under section 3will cease to be operative with effect from the 21st March, 1964. 2. It is considered desirable, after consultation with the Government of Andhra Pradesh and the Administration of the Union territories concerned, that the domicile rules framed ill respect of the areas mentioned above should be kept in force for a further period of five years. Title: Parliamentary Scrutiny of Rules

1[5. Parliamentary scrutiny of rules Every rule made under this Act shall be laid, as soon as may be after it is made, before each House of Parliament while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions, and if before the expiry of the session in which it is so laid or the session immediately following, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so however that may such modification or annulment shall be without prejudice to the validity of anything previously done under that rule. ] _________________________ 1. Substituted for "All rules made under section 3 shall, as soon as may be after they are made, be laid for not less than thirty days before each House of Parliament and shall be subject to such modifications as Parliament may make during the session in which they are so laid, or in the session immediately following. Title: Duration of Section 3 and Rules
