Indian Contract Act, 1872 Section 1

Title: Short Title, Extent and Commencement

This Act may be called the Indian Contract Act, 1872. Extent, Commencement--It extends to the whole of India1[except the State of Jammu and Kashmir]; and it shall come into force on the first day of September, 1872. Enactments Repealed-2[* * *] Nothing herein contained shall affect the provisions of any Statute, Act or Regulation not hereby expressly repealed, nor any usage or custom of trade, nor any incident of any contract, not inconsistent with the provisions of this Act _______________________ 1. Substituted by Act 3 of 1951, section 3 and Schedule, for "except part B States". 2. The Words "The enactments mentioned in the Schedule here to are repealed to the extent specified in the third column thereof, but" rep. by Act 10 of 1914, section 3 and Schedule II.

Indian Evidence Act, 1872 Complete Act

.....to another when the one is connected with the other in any of the ways referred to in the provisions of this Act relating to the relevancy of facts. "Facts in issue" " The expression "facts in issue" means and includes " any fact from which, either by itself or in connection with other facts, the existence, non-existence, nature or extent of any right, liability, or disability, asserted or denied on any suit or proceeding, necessarily follows. Explanation - Whenever, under the provisions of the law for the time being in force relating to Civil Procedure, any Court records an issue of fact, the fact to be asserted or denied in the answer to such issue is a fact in issue. Illustrations A is accused of the murder of B. At his trial the following facts may be in issue:- That caused A B's death; That A intended to cause Bs' death; That A had received grave and sudden provocation from B; That A, at the time of doing the act which caused B's death, was, by reason of unsoundness of mind, incapable of knowing its nature. CONTRACT ACT, 1872 CONTRACT ACT, 1872 9 of 1872 CHAPTER 00: PRELIMINARY SECTION 01: SHORT TITLE This Act may be called the Indian Contract Act, 1872. In this Act the following words and expressions are used in the following senses, unless a contrary intention appears from the context :- (a) When one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to such act or abstinence, he is said to make a proposal: (b) When the person to whom the proposal is made signifies his assent thereto, the proposal is said to be accepted. A proposal, when accepted, becomes a promise: (c) The person making the proposal is called the "promisor",.....

Title: Decisions in Certain Cases to Be According to Native Law

In questions regarding succession, special property of females, betrothal, marriage, divorce, dower. adoption, guardianship, minority, can bastardy, family relations, wills, legacies, gifts, partitions, or any ac religious usage or institution, the rule of decision shall be- (a) any custom applicable to the parties concerned, which is not contrary to justice, equity or good conscience, and (Civil Judicature. Descent of jaghirs. Pre-emption. Decrees cerning land. Insolvency. Minors and the Court of Wards): has not been by this or any other enactment altered abolished. and has not been declared to be void by competent authority; (b) the Muhammadan law, in cases where the parties Muhammadans, and the Hindu law, in cases where parties are Hindus, except in so far as such law has be altered or abolished by legislative enactment, or opposed to the provisions of this Act, or has been modified by any such custom as is above referred to.]

Title: Exclusion of Evidence of Oral Agreement

.....or their representatives in interest, for the purpose of contradicting, varying, adding to, or subtracting from, its terms: Proviso (1).-Any fact may be proved which would invalidate any document, or which would entitle any person to any decree or order relating thereto; such as fraud, intimidation, illegality, want of due execution, want of capacity in any contracting party 1 [want or failure] of consideration, or mistake in fact or taw: Proviso (2).-The existence of any separate oral agreement as to any matter on which a document is silent, and which is not inconsistent with its terms, may be proved. In considering whether or not this proviso applies, the Court shall have regard to the degree of formality of the document: Proviso (3).-The existence of any separate oral agreement, constituting a condition precedent to the attaching of any obligation under any such contract, grant or disposition of property, may be proved. Proviso (4).-The existence of any distinct subsequent oral agreement to rescind or modify any such contract, grant or disposition of property, may be proved, except in cases in which such contract, grant or disposition of property is by law.....
