.....(TAKING OVER OF MANAGEMENT OF CERTAIN TEA UNITS) ACT, 1986 THE TRIPURA TEA COMPANIES (TAKING OVER OF MANAGEMENT OF CERTAIN TEA UNITS) ACT, 1986 An Act to provide for taking over the management of certain Tea units specified in the schedule with a view to securing proper reorganisation and management of such Tea units so as to subserve the interests of the general public by augmenting the production and manufacture of different varieties of tea which are essential to the needs of the economy of the State and for matters connected therewith and incidental thereto. Whereas by reason of mismanagement of the affairs of Tea units specified in the First Schedule, their financial condition has become wholly unsatisfactory; And Whereas it is considered expedient to secure proper reorganization and management of the said Tea units in order to augment production and manufacture of tea by them and thereby protect the interests of the workers employed therein; Be it enacted by the Tripura Legislative Assembly in the Thirty Seventh Year of the Republic of India as follows : ------- CHAPTER I PRELIMINARY 1. Any person in whose custody a juvenile is placed In pursuance of this Act shall, while the order is in force, have the like control over the juvenile as he would have if, he were his parent, and shall be responsible for his maintenance, and the juvenile shall continue in his custody for the period stated by the competent authority, notwithstanding that he is claimed by his parent or any other person : Provided that no juvenile while in such custody shall be carried except with the permission of the competent authority.

Title: Provision as to the Holding of Offices by President and Members on Ceasing to Be Such President or Member

On ceasing to hold office,-- (a) the President shall be ineligible for further employment either under the Government of India or under the Government of a State; (b) a Member (other than the President) shall, subject to the other provisions of this Act, be eligible for appointment as the President, but not for any employment either under the Government of India or under the Government of a State; (e) the president or other Member shall not appear, act or plead before the Appellate Tribunal or the Customs, Excise and Gold (Control) Appellate Tribunal. Explanation. For the purposes of this section, employment under the Government of India or under the Government of a State includes employment under any local or other authority within the territory of India or under the control of the Government of India or under any corporation or society owned or controlled by the Government.

Title: Powers of Arbitrator and Appellate Board in Relation to Holding Enquiry Under This Act

(1) The arbitrator and Appellate Board shall, while holding an enquiry, have all the powers of a civil court under the Code of Civil Procedure, 1908 (Central Act 5 of 1908), while trying a suit, in respect of the following matters, namely : - (a) summoning and enforcing the attendance of witnesses; (b) requiring the discovery and production of any document ; (c) requisitioning any public record or copy thereof from any court or office; (d) receiving evidence on affidavits ; and (e) issuing commissions for the examination of witnesses or documents. (2) The arbitrator or the Appellate Board shall, while exercising any of the powers under this Act, be deemed to be a civil court for the purpose of sections 345 and 346 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974).
