Hindu Minority and Guardianship Act, 1956 Complete Act

.....to, and not, save as hereinafter expressly provided, in derogation of the Guardians and Wards Act, 1890 (8 of 1890)- SECTION 03: APPLICATION OF ACT (1) This Act applies- (a) to any person who is a Hindu by religion in any of its forms or developments, including a Virashaiva, a Lingayat or a follower of the Brahmo, Prarthana or Arya Samaj, (b) to any person who is a Buddhist, Jaina or Sikh by religion, and (c) to any other person domiciled in the territories to which this Act extends who is not a Muslim, Christian, Parsi or Jew by religion, unless it is proved that any such person would not have been governed by the Hindu law or by any custom or usage as part of that law in respect of any of the matters dealt with herein if this Act had not been passed. Explanation: The following persons are Hindus, Buddhists, Jainas or Sikhs by religion, as the case may be:- (i) any child, legitimate or illegitimate, both of whose parents are Hindus, Buddhists, Jainas or Sikhs by religion; (ii) any child, legitimate or illegitimate, one of whose parents is a Hindu, Buddhist, Jaina or Sikh by religion and who is brought up as a member of a tribe, community, group or family to which such.....

Ancient Monuments Preservation Act, 1904 [Repealed] Section 4

Title: Acquisition of Rights in or Guardianship of an Ancient Monument

(1) The Collector, with the sanction of the {Substituted by the A.O.1937, for "L G".} [Central Government], may purchase or take a lease of any protected monument. (2) The Collector, with the like sanction, may accept a gift or bequest of any protected monument. (3) The owner of any protected monument may, by written instrument, constitute the Commissioner the guardian of the monument, and the Commissioner may, with the sanction of the {Substituted by the A.O.1937, for " L.G.".} [Central Government], accept such guardianship. (4) When the Commissioner has accepted the guardianship of a monument under sub-section (3), the owner shall, except as expressly provided in this Act, have the same estate, right, title and interest in and to the monument as if the Commissioner had not been constituted guardian thereof. (5) When the Commissioner has accepted the guardianship of a monument under sub-section (3), the provisions of this Act relating to agreements executed under section 5 shall apply to the written instrument executed under the said sub-section. (6) Where a protected monument is without an owner, the Commissioner may assume the guardianship of the monument.

Title: Kidnapping from Lawful Guardianship

Whoever takes or entices any minor under 1 [sixteen] years of age if a male, or under 2 [eighteen] years of age if a female, or any person of unsound mind, out of the keeping of the lawful guardian of such minor or person of unsound mind, without the consent of such guardian, is said to kidnap such minor or person from lawful guardianship. Explanation.--The words "lawful guardian" in this section include any person lawfully entrusted with the care of custody of such minor or other person. Exception.--This section does not extend to the act of any person who in good faith believes himself to be the father of an illegitimate child, or who in good faith believes himself to be entitled to lawful custody of such child, unless such act is committed for an immoral or unlawful purpose. STATE AMENDMENTS 3 Manipur in section 361 for the words 'eighteen" substitute the word 'fifteen'. _______________________ 1. Substituted by Act 42 of 1949, section 2, for "fourteen". 2. .....and certain other matters connected therewith ; It is hereby enacted in the Tenth Year of the republic of India as follows: NOTES This Act has enacted to provide provisions for the preservation and protection of ancient and historical monuments and records in Assam. A greater number of famous buildings in India are already in possession or under the control of the Government but there are others worthy of preservation which are in the hands of private owners. The preservation of these is the chief object of this Act and for such performance there is already a Central Act viz., The Ancient Monuments Preservation Act, 1904. The present Assam Act is on the same subject as that of the Central Act and also with the same object in view. Preliminary 1. Short title, Extent and commencement (1) This Act may be called the Assam Ancient Monuments and Records Act, 1959 (2) It extends to the whole of Assam. (3) It shall come into force on such date as the State Government may, by notification in the official Gazette appoint. 2.
