....."Government servant" means a person appointed to any public service or post in connection with the affairs of the State of Maharashtra, whose conditions of service the State Legislature is competent to regulate. SECTION 03: PRESUMPTION OF MISCONDUCT If in an inquiry held against the Government servant for corruption, it is proved that the Government servant or any person in his behalf is in possession, or has, at any time during the period of office of such servant, been in possession, for which such servant cannot satisfactorily account, to pecuniary resources or property disproportionate to his known sources of income, then on such proof the Inquiry Officer and any other authority concerned shall presume, unless the contrary is proved, that such servant is guilty of misconduct. .....powers hereunto enabling, and in supersession of the Tamil Nadu, Village Officers Conduct Rules, 1970, the Governor of Tamil Nadu, hereby makes the following rules: RULES 1. Short title and Application.- (1) These rules may be called the Tamil Nadu Village Servants Conduct Rules, 1983. (2) They shall apply to all village servants in the State of Tamil Nadu. 2. Tamil Nadu Government Servants Conduct Rules to apply.- The Tamil Nadu Government Servants Conduct Rules, 1960, as amended from time to time, shall apply to the village servants subject to the modification specified in rule 3. 3. Private trade or employment.- The village servants being part-time Government servants, may take up part-time work or occupation. Provided that " (1) such part time work or occupation shall not interfere with their legitimate duties as village servants; and (2) the previous permission, in writing, has been applied for and obtained from the Revenue Divisional Officer concerned if the work or occupation is confined to the charge village and from the District Collector concerned, if the work or occupation extends beyond the charge village. Explanation."For the purposes of this clause an "artisan" means a person who does not employ more than ten workers in a manufacturing process on any one day of the twelve months immediately preceding. NOTES: (A) Changes made by the new amendment in two of the definitions have created disturbance in business community and especially the money-lenders who were advancing loans to traders. (B) Definition of word LOAN in sub-section 2 has been amended by addition of words WHETHER IN CASH OR KIND AND after the words ADVANCING LOANS. These words appear to have been added to clarify the word loan as to include the advance in kind like grains advanced with condition to return one and half times after harvest. The definition of word LOAN in sub section (9) even prior to the amendment states that the loan meant an advance whether of money or in kind. Thus this particular amendment.....
