The Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 Complete Act

.....after investigating into the complaint under sub-section (4) submit his report to the Court, within the time specified by it, setting out the full facts and circumstances of the case, and the efforts made by him in settling the complaint. The Court shall, on demand and on payment of such fee as may be prescribed by rules, supply a copy of the report to the complainant and the person complained against. (6) If, on receipt of the report of the Investigating Officer, the Court finds that the complaint has not been settled satisfactorily, and that facts and circumstances of the case require, that the matter should be further considered by it, the Court shall proceed to consider it, and give its decision. (7) The decision of the Court, which shall be in writing, shall be in the form of an order. The order of the Court shall be final and shall not be called in question in any civil or criminal court. (8) The Court shall cause its order to be published in such manner as may be prescribed. The order of the Court shall become enforceable from the date specified in the order. (9) The Court shall forward a copy of its order to the State Government and such officers of the State Government.....

.....this Act for the settlement of an industrial dispute have been exhausted3 [or unless the circumstances mentioned in the proviso to clause (h) of sub-section (1) of Section 97 obtain] and the majority of its members vote by ballot in favour of such strike; 4 [(vii) no stoppage which is illegal under this Act shall be sanctioned5 [resorted to, or supported] by it;] 6 [(viii) no 'go slow' shall be sanctioned, resorted to, or supported by it:] Provided that the Registrar shall not enter a union in the approved list if he is satisfied that it is not being conductedbona fidein the interest of its members but to their prejudice. 7 [Provided further that,- (a) the Registrar shall not entertain any fresh application by any union unless its previous application for being entered in the approved list is finally disposed of by him; (b) when two or more unions fulfilling the conditions necessary for being entered in the approved list apply in respect of the same industry in any local area in the same calendar month, the union having the largest membership of employees in the industry in the calendar month immediately preceding the calendar month in which they apply, shall be.....

Title: Power of Board to Order Sea-going Vessels to Use Docks, Wharves, Etc

.....or for landing or for shipping the same, any sea-going vessel within the port or port approaches which has not commenced to discharge goods or passengers, or which being about to take in goods or passengers, has not commenced to do so: Provided that before making such order, Board shall have regard, as far as possible, to the convenience of such vessel and of the shippers, in respect of the use of any particular dock, berth, wharf, quay, stage, jetty or pier: Provided further that if the Board is not the conservator of the port, the Board shall not itself make the order as aforesaid but shall require the conservator of the port, or other person exercising the rights, powers, and authorities of the conservator of the port, to make such order.

Major Port Trusts Act, 1963 Section 41

Title: Board to Declare when Vessels Other Than Sea-going Vessels Compelled to Use Docks, Wharves, Etc

.....therein it shall not be lawful, without the express sanction of the Board, to land or ship any goods or passengers out of, or into, any vessel not being a sea-going vessel, of any class specified in such order, except at such dock, berth, wharf, quay, stage, jetty or pier. (2) As from the date of the publication of the order mentioned in sub-section (1) for the third time, it shall not be lawful, without the consent of the Board, for any vessel of such class,-- (i) to land or ship any goods or passengers at any place within the limits so specified except at such dock, berth, wharf, quay, stage, jetty or pier; or (ii) while within such limits, to anchor, fasten or lie within fifty yards of the ordinary low-water mark. (3) If after the publication of such order, any such vessel shall, while within the limits so specified, so anchor, fasten or He, it shall be lawful for the Board to cause the same to be removed out of the said limits at the expense of the master or owner or agent of the vessel.

Indian Succession Act, 1925 Section 136

Title: Result of Legatee Rendering Impossible or Indefinitely Postponing Act for Which No Time Specified, and on Non-performance of Which Subject-matter to Go over

Where a bequest is made with a condition super-added that, unless the legatee shall perform a certain act, the subject-matter of the bequest shall go to another person, or the bequest shall cease to have effect but no time is specified for the performance of the act; if the legatee takes any step which renders impossible or indefinitely postpones the performance of the act required, the legacy shall go as if the legatee had died without performing such act. Illustrations (i) A bequest is made to A, with a proviso that, unless he enters the Army, the legacy shall go over to B. A takes Holy Orders, and thereby renders it impossible that he should fulfil the condition. B is entitled to receive the legacy. (ii) A bequest is made to A, with a proviso that it shall cease to have any effect if he does not marry B's daughter. A marries a stranger and thereby indefinitely postpones the fulfilment of the conditions. The bequest ceases to have effect.

1[134B. Prohibition of going armed to or near a polling station. - (1)No person, other than the returning officer, the presiding officer, any police officer and any other person appointed to maintain peace and order at a polling station who is on duty at the polling station, shall, on a polling day, go armed with arms, as defined in the Anns Act, 1959, of any kind within the neighbourhood of a polling station. (2) If any person contravenes the provisions of sub-section (1), he shall be punishable with imprisonment for a term which may extend to two years or with fine, or with both. (3) Notwithstanding anything contained in the Arms Act, 1959 (54 of 1959), where a person is convicted of an offience under this section, the arms as defined in the said Act found in his possession shall be liable to confiscation and the licence granted in relation to such arms shall be deemed to have been revoked under section 17 of that Act.
