Title: Grant of Certificates to Garden-sardars

.....recruiting area, and such person shall thereupon be entitled to recruit labour for such estate as a garden-sardar in the area specified: Provided that {Substituted by the A.O. 1937 for "the L.G. having jurisdiction over any restricted recruiting area"} [the Central Government] may, by notification in the Official Gazette, make rules {Inserted by the A.O. 1937} [as respects any restricted recruiting area] directing that certificates of garden-sardars or of specified classes of garden-sardars shall not be valid in any district in any such area until they have been endorsed as valid for that district by the District Magistrate or a Magistrate authorized by the District Magistrate in this behalf. (2) The {Substituted, by the A.O. 1937, for "L.G. of Assam"} [Central Government] may make rules {Inserted A.O. 1937} [for Assam] (a) regulating the procedure of owners and managers in granting and withdrawing such certificates, (b) prescribing the form and particulars of such certificates.

Title: Cancellation of Garden-sardars Certificate

(1) The District Magistrate of any district in respect of any art of which a garden-sardar holds a certificate may cancel the certificate if he is satisfied that the garden-sardar has contravened any of the provisions of this Act or of the rules made thereunder. (2) A District Magistrate cancelling a certificate under sub-section (1) shall record his reasons, and shall send intimation of his action to the District Magistrate of every other district in respect of any part of which the certificate was valid and to the person who granted the certificate.

WHEREAS it is expedient to enact a comprehensive legislation relating to land reforms in the Mahe region of the Union territory of Pondicherry; BE it enacted by the Legislative Assembly of Pondicherry in the Nineteenth Year of the Republic of India as follows:- CHAPTER I PRELIMINARY Short title, extent and commencement. 1. (1) This Act may be called the Mahe Land Reforms Act, 1968. (2) It extends to the whole of Mahe region of the Union territory of Pondicherry. .....Monuments Preservation Act, 1904, and the Ancient and Historical Monuments and Archaeological Sites and Remains (Declaration of National Importance) Act, 1951. The Act of 1951 merely declares certain monuments, etc., to be of national importance and the Act of 1904 applies also to such monuments. While the Constitution has distributed the subject-matter under three different heads the Act of 1904 governs all ancient monuments whether falling in the Central field or the State field, and vests all executive power in the Central Government. The position of the existing law relating to ancient monuments is far from satisfactory. The present Bill purports to be a self contained law at the Centre which will apply exclusively to ancient monument, etc., of national importance falling under Entry 67 of List I and to archaeological sites and remains falling under Entry 40 in the Concurrent List. Simultaneously, the State Governments would be advised to enact a similar law in respect of ancient monuments, etc., falling under Entry 12 in the State List. In this manner, the Central and State fields will be clearly demarcated and the existing confusion and overlapping of jurisdiction arising.....
