THE PUBLIC GAMBLING ACT, 1867 [Act, No. 3 of 1867] [25th January, 1867] PREAMBLE An Act to provide for the punishment of public gambling and the keeping of common gaminghouse in the United Provinces, East Punjab, Delhi1[and the Central Provinces]. Preamble WHEREAS it is expedient to make provision for the punishment of public gambling and the keeping of common gaming-houses2[in the United Provinces, East Punjab, Delhi and the Central Provinces]; It is hereby enacted as follows:- ________________________ 1. Substituted for "North-Western Provinces of the Presidency of Fort William and in the Punjab, Oudh" by A.C. A.O., 1948 (23-3-1948). 2. Substituted for "the C. P. and British Burma" by the Amending Act, 1903 (1 of 1903).

This Act has been re-enacted and the amendments made by section 9 and Schedule E of the said Act has been continued in force by Bom. 52 of 1947, s. 2. * * This indicates the date of .commencement of the Act. 2 This word was substituted for the word "Presidency" by Bom. 14 of 1959, s. 3 (a).

.....and the Madras Gambling Act, 1930 (Mad. Act III 1930) shall in their application to the State of Orissa be repealed. (2) Any order made and anything done under the said Acts and in force immediately before the commencement of this Act, shall continue in force and be deemed to be made or done under the corresponding provisions of this Act. (3) Such repeal shall not- (a) affect any liability incurred under the said Acts or any punishment incurred in respect of any contravention of the said Acts or any rule or order made thereunder; (b) affect any investigation, or legal proceeding in respect of any such liability or punishment as aforesaid, and any such investigation or legal proceedings may be instituted, continued or enforced and any such punishment may be imposed as if the said Acts had not expired. .....10-15, have, in the form of rules, been for some years, in force in Oudh the Central Provinces and the Punjab, and they have been found to work satisfactorily. It is obviously desirable to convert these rules into express legislative enactment, and this Bill, if it becomes law, will effect that object. Section3 Penalty for owning or keeping or having charge of a gaming house Whoever, being the owner or occupier or having the use of any house, room, tent, enclosure, space, vehicle, vessel or place in the Union Territory of Delhi opens, keeps or uses the same as common gaming-house; and whoever being the owner or occupier of any such house, room, tent, enclosure, space, vehicle, vessel or place as aforesaid, knowingly or wilfully permits the same to be opened, occupied, used or kept by any other person as a common gaming-house; and whoever has the care or management of, or in any manner assists in conducting the business of any house, room, tent, enclosure, space, vehicle, vessel or place as aforesaid, opened, occupied, used or kept for the purpose aforesaid; and whoever advances or funishes money for the purpose of gaming with persons frequenting such house, room, tent, enclosure, space, vehicle, vessel or place; shall be liable to imprisonment for a term which may extend to six months and shall also be liable to fine.....
