Heading 26.20 applies only to: (a) Ash and residues of a kind used in industry either for the extraction of metals or as a basis for the manufacture of chemical compounds of metals, excluding ash and residues from the incineration of municipal waste (heading 26.21); and (b) Ash and residues containing arsenic, whether or not containing metals, of a kind used either for the extraction of arsenic or metals or for the manufacture of their chemical compounds."; (iii) after NOTE 3, the following SUB-HEADING NOTES shall be inserted, namely:-- 'SUB-HEADING NOTES 1. For the purposes of sub-heading 2620.21, "leaded gasoline sludges and leaded anti-knock compound sludges" mean sludges obtained from storage tanks of leaded gasoline and leaded anti-knock compounds (for example, tetraethyl lead), and consisting essentially of lead, lead compounds and iron oxide. 2. Ash and residues containing arsenic, mercury, thallium or their mixtures, of a kind used for the extraction of arsenic or those metals or for the manufacture of their chemical compounds, are to be classified in sub-heading 2620.60.'; (iv) in heading No. 26.20,-- (a) for the entry in column (3), the following.....

INSECTICIDES ACT, 1968 INSECTICIDES ACT, 1968 46 of 1968 2nd September, 1968 An Act to regulate the import, manufacture, sale, transport, distribution and use of insecticides with a view to prevent risk to human beings or animals, and for matters connected therewith Be it enacted by Parliament in the Nineteenth Year of the Republic of India as follows: SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Insecticides Act, 1968. (2) It extends to the whole of India. (3)'lt shall come into force on such date1as the Central Government may, by notification in the official Gazette, appoint and different dates may be appointed for different States2. SECTION 02: APPLICATION OF OTHER LAWS NOT BARRED The provisions of this Act shall be in addi- tion to, and not in derogation of, any other law for the time being in force. Insecticides Act, 1968 Section 38

(1) Nothing in this Act shall apply to-- (a) the use of any insecticide by any person for his own household purposes or for kitchen garden or in respect of any land under his cultivation; (b) any substance specified or included in the Schedule or any preparation containing any one or more such substances, if such substance or preparation is intended for purposes other than preventing, destroying, repelling or mitigating any insects rodents fungi, weeds and other forms of plant or animal life not useful to human beings. (2) The Central Government may, by notification in the Official Gazette, and subject to such conditions, if any, as it may specify therein, exempt from all or any of the provisions of this Act or the rules made thereunder any educatidnal, scientific or research organisation engaged in carrying out experiments with insecticides.
