INSECTICIDES ACT, 1968 INSECTICIDES ACT, 1968 46 of 1968 2nd September, 1968 An Act to regulate the import, manufacture, sale, transport, distribution and use of insecticides with a view to prevent risk to human beings or animals, and for matters connected therewith Be it enacted by Parliament in the Nineteenth Year of the Republic of India as follows: SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Insecticides Act, 1968. (2) It extends to the whole of India. (3)'lt shall come into force on such date1as the Central Government may, by notification in the official Gazette, appoint and different dates may be appointed for different States2. (Extension to Acceding States and Amendment) Act, 1949 was enacted, by which the British Merchant Shipping Acts 1894 to 1938 were extended to the Acceding States (later known as Part B States) and Indian Consular Officers were empowered to perform functions in relation to Indian ships outside India and provision was made to enable Government to prescribe the proper national colours for ships registered in India, The Control of Shipping Act, 1947, was another short-term measure which continued the war-time control over Indian shipping and controlled the coastal trade by a system of licensing. .....foods, functional foods, proprietary foods, etc. Save as otherwise provided under this Act and regulations made thereunder, no person shall manufacture, distribute, sell or import any novel food, genetically modified articles of food, irradiated food, organic foods, foods for special dietary uses, functional foods, neutraceuticals, health supplements, proprietary foods and such other articles of food which the Central Government may notify in this behalf. Explanation.--For the purposes of this section,-- (1) "foods for special dietary uses or functional foods or nutraceuticals or health supplements" means: (a) foods which are specially processed or formulated to satisfy particular dietary requirements which exist because of a particular physical or physiological condition or specific diseases and disorders and which are presented as such, wherein the composition of these foodstuffs must differ significantly from the composition of ordinary foods of comparable nature, if such ordinary foods exist, and may contain one or more of the following ingredients, namely:-- (i) plants or botanicals or their parts in the form of powder, concentrate or extract in water, ethyl.....

Title: Pesticides, Veterinary Drugs Residues, Antibiotic Residues and Microbiological Counts

(1) No article of food shall contain insecticides or pesticides residues, veterinary drugs residues, antibiotic residues, solvent residues, pharmacological active substances and micro-biological counts in excess of such tolerance limits as may be specified by regulations. (2) No insecticide shall be used directly on article of food except fumigants registered and approved under the Insecticides Act, 1968(46 of 1968). Explanation.--For the purposes of this section,-- (1) "pesticide residue" means any specified substance in food resulting from the use of a pesticide and includes any derivatives of a pesticide, such as conversion products, metabolites, reaction products and impurities considered to be of toxicological significance and also includes such residues coming into food from environment; (2) "residues of veterinary drugs" include the parent compounds or their metabolites or both in any edible portion of any animal product and include residues of associated impurities of the veterinary drug concerned.

Title: Amendment of Section 3 of Act 2 of 1914

In section 3 of the Destructive Insects and Pests Act, 1914 (hereinafter referred to as the principal Act), after sub-section (2), the following sub-section shall be inserted, namely:- "(3) The Central Government may, by notification under this section, also levy and collect such fees at such and in such manner as may be specified therein for making an application for a permit to import, or for making inspection fumigation, disaffection, disinfestation or supervision of, any article or class of articles or any insect or class of insects under this section.".
