Title: Fresh Poll in the Case of Destruction, Etc., of Ballot Boxes

Title: Fresh Opinion Poll in Case of Destruction, Etc., of Ballot Boxes

.....poll at that polling station to be void, appoint a day, and fix the hours, for taking a fresh opinion poll at that polling station and notify the day so appointed and the hours so fixed in such manner as he may deem fit, or (b) if satisfied that the result of a fresh opinion poll at that polling station will not, in any way, affect the result of the opinion poll or that the error or irregularity in procedure is not material, issue such directions to the opinion poll commissioner as he may deem proper for the further conduct and completion of the opinion poll. Title: Fresh Opinion Poll in Case of Extensive Prevalence of Offences Referred to in Section 28

(1) If the Chief Election Commissioner, on receipt of a report from the opinion poll commissioner or otherwise, is satisfied that the opinion poll taken at any polling station or stations has not been a free one by reason that any of the offences referred to in section 28 has been extensively committed in connection with such poll, he may make a report to the President recommending that a fresh opinion poll be taken at such polling station or stations. (2) The president may, after considering the report of the Chief Election Commissioner, direct that a fresh opinion poll shall be taken at such polling station or stations in accordance with the previsions of this Act and the rules or orders made thereunder and give such further directions for the completion of the opinion poll as he considers necessary.

Title: Right of Holder of a Decree to Which This Act Applies to Institute Fresh Proceedings in India

Notwithstanding anything contained in section 3 of the Indian Limitation Act, 1908 ,any person in whose favor a decree to which this Act applies has been passed may, within one year from the commencement of this Act, or within one year from the date of the decree, whichever is later, institute a fresh suit or other legal proceeding in respect of the cause of action on which such decree was based, and any such suit or other legal proceeding may, notwithstanding anything contained in section 20 of the Code of Civil Procedure, 1908, or in any other law or in any agreement to the contrary relating to the place of suing, be instituted in any Court otherwise competent to try it, within the local limits of whose jurisdiction the person instituting it voluntarily resides or carries on business or personally works for gain.

Rampur Raza Library Act, 1975 Section 6

Title: Term of Office and Fresh Nomination in Certain Cases

State: Central

Year: 1975

(1) The terms of office of nominated members shall be such as may be prescribed. (2) Any nominated member may resign his office by giving notice in writing to the Government nomination him, and on such resignation being notified by the Central Government in the Official Gazette, he shall be deemed to have vacated his office on the date of public of such notification. (3) If the office of any nominated members is vacated before the expiry of the term of his office, the resulting vacancy may be filled by fresh nomination by the Government by which such members was nominated, and the members so nominated shall hold office for the remainder of the term of office of the member in whose place he is nominated. (4) An outgoing member shall be eligible for re-nomination. (5) If any nominated member is, by infirmity or otherwise, rendered temporarily incapable of carrying out his duties or is absent on lave or otherwise in circumstance not involving the vacation of his office, the Central Government or the State Government, as the case may, be may nominate another person to act in his place during his absence.

Title: Term of Office and Fresh Nomination in Certain Cases

(1) The terms of office of nominated members shall be such as may be prescribed. (2) Any nominated member may resign his office by giving notice to writing to the Central Government and to the State Government, and no such resignation being notified by the Central Government in the Official Gazette, shall be deemed to have vacated his office. (3) A causal vacancy created by the resignation of a nominated member under sub-section (2) or for any other reason may be filed by fresh nomination by the Central Government or the State Government as the case may be, and a member so nominated shall hold office for the remaining period for which the member in whose place he is nominated would have held office. (4) An outgoing member shall be eligible for renomination. (5) If any nomination member is by infirmity or otherwise rendered temporarily incapable of carrying out his duties or is absent on leave or otherwise in circumstances not involving the vacation of his office, the Central Government or the State Government, as the case may be, ma nominate, another person to act in his place during his absence.

Title: Payment No Bar for Acquisition Under a Fresh Declaration

If any land, in respect of which the payment of a betterment tax has been accepted or determined under section 20 be subsequently required for any of the purposes of this Act, the acceptance or payment shall not be deemed to prevent the acquisition of the land in pursuance of a fresh declaration published under section 6 of the Land Acquisition Act, 1894.
