THE BOMBAY FORFEITED LANDS RESTORATION ACT, 1938 [Act No. 22 of 19381] [29th November 1938] PREAMBLE An Act to provide for the restoration of lands forfeited during the Civil Disobedience Movement for the non-payment of land revenue and other sums due to Government. WHEREAS certain lands were forfeited as a result of the Civil Disobedience Movement for the non-payment of land revenue and other sums due to Government; AND WHEREAS the said lands were disposed of to certain persons for inadequate consideration; AND WHEREAS it is just and expedient to acquire them with a view to restore them to the original holders thereof; It is hereby enacted as follows :- _______________________________ 1. .....civil court as specified in section 15 - RULE 09: JOINT HEARING AND DISPOSAL OF APPEALS In a case where two or more appeals are filed against an order or orders of the competent authority, such of the appeals as may be heard and disposed of together may be disposed of by a single order. RULE 10: GROUNDS WHICH MAY BE TAKEN IN APPEAL The appellant shall not, except with the leave of the Tribunal, urge or be heard in support of any ground not set forth in the memorandum of appeal, but the Tribunal, in deciding the appeal, shall not be confined to the grounds set forth in the memorandum of appeal or taken with the leave of the Tribunal under this rule: Provided that the Tribunal shall not rest its decision on any ground other than the grounds set forth in the memorandum of appeal unless the party which may be affected thereby has had a reasonable opportunity of being heard on that ground. .....and includes his heirs. (3) "Prescribed" means prescribed by rules. (4) "Tribunal" means the Tribunal constituted under section 3. (5) "Rules" means rule made under section 14. (6) Words and expressions not defined in this Act but defined in the Land Acquisition Act, 1894, shall have the meanings assigned to them in that Act. 3. Constitution of Tribunal :- For the purposes of this Act, the Provincial Government shall constitute a Tribunal consisting of such member or members as the Provincial Government may appoint. If the Tribunal consists of one member, such member, and if it consists of more than one member, the President, shall be a person who is or has been a Judge of a High Court. 4. Declaration that land is needed for restoration :- (1) The Provincial Government, if it is satisfied that any of the forfeited lands is needed for a public purpose and should, therefore, in public interest be acquired and restored to the original holder, may make a declaration that the said land is needed for such purpose. Title: Procedure when Bond Has Been Forfeited

(1) Where a bond under this Code is for appearance, or for production of property, before a Court and it is proved to the satisfaction of that Court or of any Court to which the case has subsequently been transferred, that the bond has been forfeited, or where in respect of any other bond under this Code, it is proved to the satisfaction of the Court by which the bond was taken, or of any Court to which the case has subsequently been transferred, or of the Court of any Magistrate of the first class, that the bond has been forfeited, the Court shall record the grounds of such proof, and may call upon any person bound by such bond to pay the penalty thereof or to show cause why it should not be paid. Explanation.-A condition in a bond for appearance, or for production of property, before a Court shall be construed as including a condition for appearance, or as the case may be, for production of property before any Court to which the case may subsequently be transferred. In this Act, unless there is anything repugnant in the subject or context - (1) "Forfeited land" means any of the lands forfeited to the Crown during the Civil Disobedience Movement in any of the years 1930 to 1934 for non-payment of land revenue or other sums due to Government and specified in the notification published in the Official Gazette by the Provincial Government within six months from the date on which this Act comes into force. The expression "Forefeiture of lands" shall be construed accordingly. (2) "Original holder" in relation to any forfeited land means a person who owned the land at the time of its forfeiture and includes his heirs. (3) "Prescribed" means prescribed by rules. (4) 'Tribunal" means the Tribunal constituted under section 3. (5) "Rules" means rules made under section 14. (6) Words and expressions not defined in this Act but defined in the Land Acquisition Act, 1894, shall have the meaning assigned to them in that Act.
