Karnataka Prohibition Act, 1961 Section 87

Title: Procedure to Be Followed by Magistrates

State: Karnataka

(1) In all trials for offences under this Act, the Magistrate shall follow the procedure prescribed in the Code of Criminal Procedure, 1898, for the trial of summary cases in which an appeal lies: Provided that if in respect of any case, the Magistrate, for reasons to be recorded in writing, decides that it is not desirable to follow such procedure, he shall follow the procedure prescribed in Chapter XX or Chapter XXI of the said Code, according as the case is, a summons case or a warrant case. (2) Save as otherwise expressly provided in this Act, all investigations, arrests, detentions in custody and searches shall be in accordance with the provisions of the Code of Criminal Procedure, 1898: Provided that no search shall be deemed to be illegal by reason only of the fact that witnesses for the search warrant are not inhabitants of the locality in which the place searched is situated.

Industries (Development and Regulation) Act, 1951 Section 18FE

Title: Provisions Where Government Decides to Follow the Course of Action Specified Insection 18-fd (1)

Insecticides Act, 1968 Section 22

Title: Procedure to Be Followed by Insecticide Inspectors

(2) Where an Insecticide Inspector takes any action under clause (d) of sub-section (1) of Section 21 -- (a) he shall use all despatch in ascertaining whether or not the insecticide or its sale, distribution or use contravenes any of the provisions of section 18 and if it is ascertained that the insecticide or its sale, distribution or use does not so contravene, forthwith revoke the order passed under the said clause or, as the case may be, take such action as may be necessary for the return of the stock seized; (b) if he seizes the sk of the insecticide, he shall, as soon as may be, inform a Magistrate and take his orders as to the custody thereof; (c) without prejudice to the institution of any prosecution, if the alleged contravention be such that the defect may be remedied by the possessor of the insecticide, he shall, on being satisfied that the defect has been so remedied, forthwith revoke his order and in case where the Insecticide Inspector has seized the sk of insecticide, he shall, as soon as may be, inform a Magistrate and obtain his orders as to the release thereof. 1[(3) Where an.....

.....safety standards and practices; (b) carry out risk management which shall include taking into account the results of risk assessment, and other factors which in the opinion of the Food Authority are relevant to the matter under consideration and where the conditions are relevant, in order to achieve the general objectives of regulations; (c) where in any specific circumstances, on the basis of assessment of available information, the possibility of harmful effects on health is identified but scientific uncertainty persists, provisional risk management measures necessary to ensure appropriate level of health protection may be adopted, pending further scientific information for a more comprehensive risk assessment; (d) the measures adopted on the basis of clause (c) shall be proportionate and no more restrictive of trade than is required to achieve appropriate level of health protection, regard being had to technical and economic feasibility and other factors regarded as reasonable and proper in the matter under consideration; (e) the measures adopted shall be reviewed within a reasonable period of time, depending on the nature of the risk to life or health being.....

Delhi Rent Act, 1995 Section 45

Title: Procedure to Be Followed by Rent Authority

(c) The Rent Authority shall give to the tenant leave to contest the application if the affidavit filed by the tenant discloses such facts as would disentitle the landlord from obtaining an order for the recovery of possession of the premises. (d) Where leave is granted to the tenant to contest the application, the Rent Authority shall ordinarily commence the hearing of the application within seven days of the grant of such leave and shall provide day to day hearing and shall dispose of the application within thirty days of starting of such hearing, failing such commencement of hearing or disposal of application within such time, the Rent Authority shall inform the Chairman of the Tribunal the reasons therefore. Title: Procedure to Be Followed in Case of Sales

Save as hereinbefore provided, when any property is directed to be sold under this Act, the following procedure shall, as far as practicable, be adopted, namely:-- (a) if the property be sold under a decree or order of the High Court of Calcutta, Madras or Bombay, in the exercise of its original jurisdiction,1[*****] the procedure of such court in its original civil jurisdiction for the sale of property by the Registrar; (b) if the property be sold under a decree or order of any other court, such procedure as the High Court mayfrom time to time by rules prescribe in this behalf, and until such rules-art made the procedure prescribed in the Code of Civil Procedure2in respect of sales in execution of decrees. _________________________ 1. Prasar Bharati (Broadcasting Corporation of India) Act, 1990 Section 15

Title: Jurisdiction Of, and the Procedure to Be Followed By, Broadcasting Council

.....and within such period as may be specified by regulations. (3) The Broadcasting Council shall follow such procedure as it thinks fit for the disposal of complaints received by it. (4) If the complaint is found to be justified either wholly or in part, the Broadcasting Council shall advise the Executive Member to take appropriate action. (5) If the Executive Member is unable to accept the recommendation of the Broadcasting Council, he shall place such recommendation before the Board for its decision thereon. (6) If the Board is also unable to accept the recommendation of the Broadcasting Council, it shall record its reasons therefor and inform the Broadcasting Council accordingly. (7) Notwithstanding anything contained in sub-sections (5) and (6), where the Broadcasting Council deems it appropriate, it may, for reasons to be recorded in writing, require the Corporation to broadcast its recommendations with respect to a complaint in such manner as the Council may deem fit.
