Tobacco Board Act, 1975 Chapter III

Title: Regulation of Production and Disposal of Virginia Tobacco

.....demand for virginia tobacco in India and abroad, and the suitability of the land in relation to which the certificate is applied for and such other factors as may, having regard to the needs of the virginia tobacco industry, be prescribed. (3) A certificate of registration granted in pursuance of this section shall be valid for such period as may be prescribed. (4) Every application for such certificate of registration shall be accompanied by such fees (not exceeding one rupee for 0.4 hectre of the land in relation to which such application has been made) as may be prescribed. Section 10A - Registration of growers of virginia tobacco seedlings for commercial purposes 1[10A. Registration of growers of virginia tobacco seedlings for commercial purposes.- (1) No person shall grow virginia tobacco seedlings for commercial purposes unless he registers himself as a nursery grower with the Board in accordance with the rules made under this Act. Explanation.- For the removal of doubts, it is hereby declared that nothing in this sub-section shall apply to the growing by a registered grower of any virginia tobacco seedlings for his own use. Tobacco Board Act, 1975 Section 11B

Title: Licences to Be Obtained for Grading Work and Construction of Barns, Etc

No person shall (i) take up grading work relating to virginia tobacco for commercial purposes; or (ii) take up the construction and operation of a barn, unless he obtains a licence from the Board in accordance with the rules made under this Act. Explanation. For the purposes of this section, (i) "barn" means a building or structure with a roof of zinc sheets or tiles having flue pipes, furnace and tiers used for flue curing of tobacco leaves; (ii) "grading work" means separating tobacco leaves into specific grades on the basis of plant position, maturity, colour, body and blemish and in accordance with such specifications as may be prescribed.]

Tobacco Board Act, 1975 Complete Act

.....and Industrial Development, Indian Council of Agricultural Research, growers of tobacco, dealers or exporters of tobacco and tobacco products, manufacturers of tobacco products, and of the representatives of the tobacco growing States. It is proposed to vest the Board with adequate powers to deal with various aspects of the industry. 4. The finances of the Board will consist of the fees collected by it, grants or loans made by the Central Government or by any person and the sums realised by the Board in the discharge of its functions. 5. To ensure that the Board has adequate resources, it is proposed to undertake separately legislation for the imposition, by way of cess of a duty of excise on Virginia tobacco which is produced in India and a duty of customs on all tobacco which is exported and for making over the proceeds, after due appropriation by Parliament by law, to the Board. 6. It is also proposed to take power for the Central Government to prohibit or control the imports and exports of tobacco and tobacco products either generally or in specified classes of cases. 7. Title: Laying of Supply Pipes, Etc.

.....cost incurred in laying the main instead of a supply pipe shall be borne by him. (4) Notwithstanding anything contained in the foregoing provisions of this section, the Chairperson may, within a reasonable time after the service of the notice upon him, require the person giving the notice either to pay. to him, in advance the cost of the work, as estimated by the Chairperson or any officer authorised by in this behalf or to give security for payment thereof to his satisfaction. (5) If any payment made to the Chairperson under sub-section (4) exceeds the expenses which the Chairperson would be entitled to recover from the person giving the notice, the excess shall be repaid by him and if and so far as those expenses are not covered by the payment, the Chairperson may recover the balance from such person as an arrear of tax under this Act.

Title: Laying of Supplying Pipes, Etc.

(4) Notwithstanding anything contained in the foregoing provisions of this section, the Commissioner may, within a reasonable time after the service of the notice upon him, require the person giving the notice to pay to it in advance, the cost of the work as estimated by the corporation or to give security for payment thereof to its satisfaction. (5) If any payment made to the corporation under sub-section (4) exceeds the expenses which it would be entitled to recover from the person giving the notice, the excess shall be repaid by it and if and so far as those expenses are not covered by the payment, the corporation may recover the balance from such person as an arrear of water rate under this Act.

New Delhi Municipal Council Act 1994 Section 160

Title: Power to Require Separate Service Pipes

State: Central

Year: 1994

(1) The Chairperson may require the provision of a separate service pipe for each of the premises supplied or to be supplied by him with water. (2) If, in the case of any premises already supplied with water but not having a separate service pipe, the Chairperson gives notice to the owner of the premises requiring the provision of such a pipe, the owner shall, within three months, lay so much of the required pipe as will constitute a supply pipe and is not required to be laid in a street, and the Chairperson, shall, within fourteen days after the owner has done so, lay so much of the required pipe as will constitute a communication pipe or a supply pipe to be laid in a street and make all necessary communications. (3) If an owner upon whom a notice has been served under sub-section (2) fails to comply therewith the Chairperson may himself execute the work which the owner was required to execute and recover the expenses reasonably incurred by him in executing the work as an arrear of tax under this Act.
