.....in the case of Industrial establishments owned or controlled by the Government of India, the number of such other holidays shall be seven including first day of May and first day of November. (2) Whenever there is any disagreement between the employer and employees or the trade Unions concerned as to the festivals to be allowed as holidays during each calendar year the employer or the employees of the concerned Trade Union shall refer the dispute to the Inspector, having jurisdiction over the area in which the Industrial establishment is situated, for his decision and his decision shall be final. ________________________ 1. The Punjab Industrial Establishment (National and Festival Holidays and Casual and Sick Leave) Act, 1965 Complete Act

.....person shall be deemed to be the employer; (d) "Government means the Government of the State of Punjab; (e) Industrial establishment" means" (i) any factory as defined in clause (m) of section 2 of the Factories Act, 1948 (Central Act 63 of 1948), or any place which is deemed to be a factory under sub-section (2) of section 85 of that Act; or (ii) any plantation as defined in clause (f) of section 2 of the Plantation Labour Act, 1951 (Central Act 69 of 1951); (f) "inspector" means and Inspector appointed under sub-section (1) of section 7; (g) "prescribed" means prescribed by rules made under this Act; (h) "wages" means all remuneration (whether by way of salary, allowances or otherwise) expressed in terms of money or capable of being so expressed which would, of the term of employment, express or implied where fulfilled, be payable to a worker in respect of his employment or of work done in such employment, but does not include: (a) any bonus; (b) the value of any house accommodation, supply of light, water, medical facilities or other amenity or of any service or of any confessional supply of food grains or other articles; (c) any contribution paid or payable by the employer: -.....

Amendment of section 5."In section 5 of the principal Act, " (1) for sub-section (2), the following sub-section shall be substi tuted, namely:" "(2) Where an employee works on any holiday allowed under section 3, he shall be entitled to twice the wages and to avail himself of a substituted holiday on any other day." .....3.- In the Kerala Industrial Establishments (National and Festival Holidays) Act, 1958 (47 of 1958) (hereinafter referred to as the principal Act), in section 3, for the words and figure "and the 1 st May and four" the words and figures "the 1 st May and the 2 nd October and nine" shall be substituted. 3. Amendment of section 5.- In section 5 of the principal Act,- (i) for sub-section (1), the following sub-section shall be substituted, namely:- "(1) Notwithstanding any contract to the contrary, every employee shall be paid wages for each of the holidays allowed to him under section 3, whether or not the employer has not required, or could not require, him under sub-section (1) of section 4A to work on that holiday or whether that holiday falls or does not fall during the period of a strike or illegal lock-out: Provided that if such holiday falls during the period of a lay off, the employee shall be paid fifty per cent of the total of the basic wages and dearness allowance that he would have been entitled to, had he not been so laid off: Provided further that no such employee shall be entitled to be paid any wages for any of the holidays if such holiday falls during the.....

This Act may be called the Orissa Industrial Establishments (National and Festival) Holidays (Amendment) Act, 1992. 2. Amendment of section 3. In the Orissa Industrial Establishments (National and Festival) Holidays Act, 1969, section 3 shall be renumbered as sub-section (1) thereof and after sub-section (1) as so renumbered, the following sub-section shall be inserted, namely:" "(2) In addition to the holidays provided in sub-section (1), in the event of any general election or bye-election to Parliament or the State Legislative Assembly, the date of every such election as notified by the Election Commission shall be allowed as a holiday of one whole day:- Provided that in the case of a bye-election, the date of such election shall be allowed as a holiday only in respect of employees who belong to the concerned constituency".
