.....inconsistent with the scheme ofFederation embodied in this Act: Providedthat after the establishment of the Federation, if any Instrument has in factbeen accepted by His Majesty, the validity of that Instrument or of any of itsprovisions shall not be called in question and the provisions of this Act shall,in relation to the State, have effect subject to the provisions of theInstrument. (5)It shall be a term of every Instrument of Accession that the provisions of thisAct mentioned in the Second Schedule thereto, may, without affecting theaccession of the State, be amended by or by authority of Parliament, but notsuch amendment shall, unless it is accepted by the Ruler in a supplementaryInstrument, be construed as extending the functions which by virtue of theInstrument are exercisable by His Majesty or any Federal Authority in relationto the State. .....Tribunal toexercise such jurisdiction as is conferred on it by this Act, and for thatpurpose the Tribunal may make such orders, including interim orders, ordersvarying or discharging a direction or. other of the Authority, orders for thepay-ment of compensation or damages and of costs and orders for the pro-ductionof documents and the attendance of witnesses, as the circumstances of the casemay require, and it shall be the duty of the Authority and of every FederatedState and of every other person or authority affected thereby to give effect toany such order. (4) An appeal shall lie to the Federal Court from anvdecision of the Railway Tribunal on a question of law, but no appeal shall liefrom the decision of the Federal Court on any such appeal. (5) The Railway Tribunal or the Federal Court, as the casemay be, may, on application made for the purpose, if satisfied that in view of analteration in the circumstances it is proper so to do, vary or revoke anyprevious order made by it. (6) The President of the Railway Tribunal may, with theapproval ofthe Governor-General in his discretion, make rules regulating thepracticeand procedure of the Tribunal and the fees to be taken.....

Section 8 - Extent of Executive Authority of the Federation (1) Subject to the provisions of this Act,the executive authority of the 1 [Federation]extends-- (a) to the matters with respect to which the 1 [Federal] Legislature has power to make laws; (b) to the raising in British India on behalf of His Majesty of naval, military and air forces and to the governance of His Majesty's forces borne on the Indian establishment; (c) to the exercise of such rights, authority and jurisdiction as are exerciseable by His Majesty by treaty, grant, usage, sufferance, or otherwise in and in relation to the tribal areas: Provided that-- (i) the said authority does not, save as expressly provided in this Act, extend in any Province to matters with respect to which the Provincial Legislature has power to make laws; (ii) the said authority does not, save as expressly provided in this Act, extend in any 2 [Federated] State save to matters with respect to which the 1 [Federal] Legislature has power to make laws for that.....

Federal Court (Enlargement of Jurisdiction) Act, 1947 Complete Act

.....day is pending before His Majesty in Council, if the records pertaining to such appeal have before that day been transmitted by the High Court concerned to His Majesty in Council ; or (b) to the bringing of which to His Majesty in Council special leave has been granted before the appointed day; and any such appeal may be disposed of by His Majesty in Council as if this Act had not been passed. 1 [318. Provisions as to Federal Court and certain other Federal authorities (1) Notwithstanding that the Federation has not yet been established, the Federal Court and the Federal Public Service Commission and the Federal Railway Authority shall come into existence and be known by those names, and shall perform in relation to British India the like functions as they are by or under this Act to perform in relation to the Federation when established. (2) Nothing in this section affects any power of His Majestv in Council to fix a date later than the commencement of Part III of this Act for the coming into operation, either generally or for particular purposes, of any of the provisions of this Act relating to the Federal Court, the Federal Public Service Commission or the Federal Railway Authority. ________________________ 1. Title: Constitution, Functions and Management of Federal Co--operative
