THE KARNATAKA INDUSTRIES (FACILITATION) ACT, 20021 [Act, No. 45 of 2003] [27 October, 2003] PREAMBLE An Act to provide for the promotion of industrial development and facilitation of new investments to simplify the regulatory frame work by reducing procedural requirements and rationalising documents and to provide for an investor friendly environment in the State of Karnataka. Whereas, it is expedient to provide for speedy implementation of industrial and other projects in the State by providing single point guidance and assistance to promoters, reducing the procedural requirements rationalising documents and to ensure smooth operation; Be it enacted by the Karnataka State Legislature in the Fifty third year of the Republic of India as follows:- ________________________ 1. .....by Industries Department from time to time; (i) 'Industrial Unit' means any industrial undertaking located inside the Slate and engaged in any manufacturing or servicing activity as detailed in the Industrial Policy Resolution from time to time; (j) 'Nodal Agency' means the Nodal Agency at the Slate Level or at the District Level constituted under Section 8 of this Act; (k) 'Notification' means a notification published in the Orissa Gazette and the word ˜notify' will be construed accordingly; (l) 'Prescribed' means prescribed by rules made under this Act; and (m) 'State Level Single Window Clearance Authority" means a Committee constituted under Section 4 of this Act. 1[7B. Composition of Industry Facilitation Council (1) The Industry Facilitation Council shall consist of one or more members to be appointed from amongst the following categories:-- (i) Director of Industries by whatever name called or any other officer not below the rank of such Director, of the Stale Government; (ii) representatives of banks and financial institutions; (iii) office bearers or representatives of State Induslry Associations; and (iv) persons having special knowledge in the field of industry, Finance, Law, Trade and Commerce. (2) The person appointed under clause (i) of sub-section (1) shall be the Chairperson of the Industry Faeilitation Council. Title: Reference to Micro and Small Enterprises Facilitation Council

.....between the parties,the Council shall either itself take up the dispute for arbitration or refer toit any institution or centre providing alternate dispute resolution services forsuch arbitration and the provisions of the Arbitration and Conciliation Act,1996(26 of 1996) shall then apply to the dispute as if the arbitration was inpursuance of an arbitration agreement referred to in sub-section (1) of section7 of that Act. (4) Notwithstanding anything contained in any other law forthe time being in force, the Micro and Small Enterprises Facilitation Council orthe centre providing alternate dispute resolution services shall havejurisdiction to act as an Arbitrator or Conciliator under this section in adispute between the supplier located within its jurisdiction and a buyer locatedanywhere in India. (5) Every reference made under this section shall be decidedwithin a period of ninety days from the date of making such a reference.
