Ancient Monuments and Archaeological Sites and Remains Act, 1958 Section 23

Title: Compulsory Purchase of Antiquities, Etc., Discovered During Excavation Operations

.....as the case may be, shall keep them in such safe custody as he may deem fit . (3) On receipt of a report under sub -section ( 1), the Central Government may make an order for the2[compulsory acquisition of any such antiquities] . (4) When an order for the1[compulsory acquisition] of any antiquities is made under sub -section ( 3), such antiquities shall rest in the Central Government with effect from the date of the order . _________________________ 1. Substituted for the words "compulsory purchase" by the Antiquities and Art Treasures Act (52 of 1972), section 33(iii) (a) (05-04-1976). 2. Substituted for the words "compulsory purchase of any such antiquities at their market value" by the Antiquities and Art Treasures Act (52 of 1972), section 33(iii) (b) (05-04-1976).

Title: Power of Central Government to Make Rules Regulating Archaeological Excavation in Protected Areas

.....conditions on which such licences may be granted, the form of such licences, and the taking of security from licensees; (c) prescribing the manner in which antiquities found by a licensee shall be divided between {Substituted by the A.O.1937, for "Govt.".}[the Central Government] and the licensee; and (d) generally to carry out the purposes of section 20. (2) The power to make rules given by this section is subject to the condition of the rules being made after previous publication. (3) Such rules may be general for all protected areas for the time being, or may be special for any particular protected area or areas. (4) Such rules may provide that any person committing a breach of any rule or of any condition of a licence shall be punishable with fine which may extend to five thousand rupees, and may further provide that where the breach has been by the agent or servant of a licensee the licensee himself shall be punishable.

An archaeological officer or an officer authorised by him in this behalf or any person holding a licence granted in this behalf under this Act (hereinafter referred to as the licensee) may, after giving notice in writing to the Collector and the owner, enter upon and make excavations in any protected area.

Where an archaeological officer has reason to believe that any area not being a protected area contains ruins or relies of historical or archaeological importance, he or an officer authorised by him in this behalf may, after giving notice in writing to the Collector and the owner, enter upon and make excavations in the area.

No State Government shall undertake or authorise any person to undertake any excavation or other like operation for archaeological purposes in any area which is not a protected area except with the previous approval of the Central Government and in accordance with such rules or directions, if any, as the Central Government may make or give in this behalf.

Title: Power to Enter Upon and Make Excavations in a Protected Area

(1) Any officer of the Archological Department or any person holding a licence under section 20B may, with the written permission of the Collector. enter upon and make excavations in any, protected area. (2) Where, in the exercise of the power conferred by sub-section (1), the rights of any person are infringed by the occupation or disturbance of the surface of any land, {Substituted by the A.O.1937, for "the Govt.".}[the Central Government] shall pay to that person compensation for the infringement.
