Extradition Act, 1962 Section 27

Title: Lawfulness Of, and Retaking on Escape from Custody Under Warrants

State: Central

Year: 1962

It shall be lawful for any person to whom a warrant is directed for the apprehension of a fugitive criminal to hold in custody and convey the person mentioned in the warrant to the place named in the warrant and if such person escapes out of any custody to which he may be delivered in pursuance of such warrant, he may be re-taken as a person accused of an offence against the law of India (may be re-taken) upon an escape.

Title: Escape of Prisoner from Custody

(1) If a prisoner while in custody in pursuance of this Act, or under a warrant issued in pursuance of this Act, escapes by breach of prison or otherwise, out of custody, he may be retaken in the same manner as a person convicted of a crime against the law of the place to which he escapes may be retaken upon an escape (2) A person guilty of the offence of so escaping or of attempting so to escape, or of aiding or attempting to aid any such prisoner so to escape, may be tried in any of the following parts of Her Majesty's dominions, namely, the part to which and the part from which the prisoner is being removed or returned, and the part in which the prisoner escapes and the part in which the offender is found and such offence shall be deemed to be an offence against the law of the part of Her Majestys dominions in which he may be so tried, and for alt purposes of and incidental to the apprehension, trial, and punishment of the person accused of such offence, and of and incidental to any proceedings and matters preliminary, incidental to or consequential thereon, and of and incidental to the jurisdiction of any Court constable or officer With reference to such offence, and to.....

Title: When Police May Arrest Without Warrant

.....with such evidence in any manner; or (d) to prevent such person from making any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the police officer; or (e) as unless such person is arrested, his presence in the Court whenever required cannot be ensured, and the police officer shall record while making such arrest, his reasons in writing. Borstal School Act, 1963 Section 21

Title: Arrest of Offender Escaping from Borstal School or Escaping from Supervision

Any offender, who, in contravention of the provisions of this Act, has escaped from a Borstal School or has escaped from a civil hospital to which he was removed for treatment under section 14 or has escaped from the supervision of any authority, institution, society, or person under whose supervision he has been directed to remain or has been permitted to live by licence under section 15, or has committed a breach of any of the conditions imposed under section 19, may be arrested by any officer of the Police without a warrant and without an order of the Magistrate and sent back to the Borstal School or civil hospital or to such authority, institution, society or person, as the case may be.

Bombay Borstal Schools Act, 1929, (Maharashtra) Section 18

Title: Arrest of Offender Escaping from Borstal School, or Escaping from Supervision

Repatriation of Prisoners Act, 2003 Section 13

Title: Determination of Prison and Issue of Warrant for Receiving Transfer in India

(2) The Central Government shall authorise any officer not below the rank of a Joint Secretary to that Government to issue a warrant under sub-section (2) of section 12 and to direct the officer referred to in sub-section (1) to receive and hold the prisoner, with respect to whom the warrant is issued, in custody, (3) It shall be lawful for the officer referred to in sub-section (1) to receive and hold in custody any prisoner delivered to him under the direction made in the warrant issued under sub-section (2) of section 12 and to convey such prisoner to any prison determined under sub-section (1) for being dealt with in accordance with the said warrant and if the prisoner escapes from such custody, the prisoner may be arrested without warrant by any person who shall without undue delay deliver such prisoner to the officer in charge of the nearest police station and the prisoner so arrested shall be liable for committing an offence under section 224(45 of 1860.) of the Indian Penal Code and shall also be liable to be dealt with in accordance with the said warrant. (4) A warrant under sub-section (2) of section 12 shall provide for-- (a) the bringing of the prisoner.....

Lepers Act, 1898 Section 12

Title: Re-arrest of Escaped Lepers

Whoever, having been sent to a leper asylum under an order of a Magistrate in Form C or Form D set forth in the Schedule, escapes from, or leaves, the asylum without the permission in writing of the Superintendent thereof, may be arrested {Subs. by Act 22 of 1920, section 6, for ''by any police officer without a warrant''.} [with out a warrant by any police officer or by any other person especially empowered by the State Government by order in writing in this behalf, ] and upon arrest shall be forthwith taken back to the leper asylum.
