THE KARNATAKA PRESERVATION OF TREES ACT, 1976 PREAMBLE An Act to make better provision for preservation of trees in the State Whereas with the growing pace of urbanisation, industrialisation and increasing population, there has been indiscriminate felling of a large number of trees in the rural and urban areas of the State of Karnataka leading to erratic rainfall, recurring famines and floods, soil erosion and consequent ecological disturbances; Whereas it is expedient to provide for the preservation of trees in the State by regulating the felling of trees and for the planting of adequate number of trees to restore ecological balance and for matters connected therewith; Be it enacted by the Karnataka State Legislature in the Twenty-seventh Year of the Republic of India as follows :

THE KARNATAKA PRESERVATION OF TREES ACT, 19761 [Act, No. 76 of 1976] [1st December, 1976] PREAMBLE An Act to make better provision for preservation of trees in the State. INCHEK TYRES LIMITED AND NATIONAL RUBBER MANUFACTURERS LIMITED (NATIONALISATION) ACT, 1984 INCHEK TYRES LIMITED AND NATIONAL RUBBER MANUFACTURERS LIMITED (NATIONALISATION) ACT, 1984 17 of 1984 31st March, 1984 STATEMENT OF OBJECTS AND REASONS Act No. 17 of 1984.- The Inchek Tyres Limited commenced production of automobile tyres and tubes in Kakinara (West Bengal) in 1963. The undertaking started showing unfavourable operational results after 1970 and by June, 1977 the company had an accumulated loss of Rs. 8.9 crores as against the paid up capital of Rs. 3 crores. The management of the undertaking was taken under the Industries (Development and Regulation) Act, 1951, on the 13th April, 1978. The undertaking employs about 1,380 persons. 2. The National Rubber Manufacturers Limited, Calcutta, have two units. The unit at Tangra (Calcutta) produces cycle tyres, tubes and rubber goods like fan and V belts, transmission and conveyor belts, hoses, etc., and the other unit at Kalyani produces reclaimed rubber. In early 1970s, the production at both the units was affected due to labour trouble, erratic power supply, shortage of certain raw materials and poor quality of the.....

(2) Whoever is found to be in the possession of any metal, which contains alloys in the same proportions in which they have been used in the manufacture of any small coin, shall be presumed, until the contrary is proved, to have contravened the provisions of sub-section (i). (3) Nothing contained in sub-section (1) or sub-section (2) shall apply to the mint. SECTION 04: PENALTY FOR CONTRAVENTION OF SECTION 2 - Whoever contravenes any provision of sub-section (1) of section 3 -without any reasonable excuse, the burden of proving of which shall lie on such person. shall be punishable with imprisonment for a term of not less than three months but not more than five years. SECTION 05: OFFENCES BY COMPANIES (1) Where an offence against this Act has been committed by a company, every person who, at the time the offence was committed, was in charge of, and was responsible to, the company for the conduct of its business, shall be deemed to be guilty of the offence shall be liable to be proceeded against and punished accordingly : Provided that nothing contained in this sub-section shall render any person liable to punishment, if he proves that the offence was committed.....

Registration of the existing wells of the notified area.--(1) Every owner of the existing wells of the notified area in the State shall, within a period of one hundred and twenty days from the date of constitution of the Authority, register the wells existing and in use and shall apply to the Authority in such form and in such manner as may be prescribed for a certificate of registration: Provided that if the Authority is satisfied that there are sufficient reasons for the applicant for not submitting the application within the said time limit it may entertain the application submitted thereafter. (2) The details to be furnished in an application under sub-section (1) shall contain such particulars and shall be in such manner as may be prescribed. (3) On receipt of an application under sub-section (1) the Authority shall, if satisfied that it shall not be against the public interest so to do, register the well subject to such conditions and restrictions as may be prescribed and issue a certificate.....
