Eradication of Unfair Activities at Pandharpur Temples (for Providing Better Facilities for Worship) Act, 1980 Complete Act

.....of these Temples; AND WHEREAS in view of continuous litigation by the interested parties, it has not been possible to bring the provisions of the Act into force, except sections 1(2), 21 to 31, 33, 34, 38 and 39 thereof; AND WHEREAS it appears that it will take some years to get a final decision of the Court in this matter, where the validity of the Act itself has also been challenged; AND WHEREAS, complaints have been received by Government from a large number of devotees of God Vithoba and Goddess Rukmini visiting the Pandharpur Temples that they are being exploited by the priests at the Temples by demanding unreasonable dakshinas, offerings, donations, gifts, fees or other charges for allowing them to enter the Temples for worshipping or for performing any religious service or ceremonies therein and on failure to meet the demands of the priests the devotees are being insulted, abused or cursed and even molested physically; AND WHEREAS, on account of the aforementioned activities of the priests, there has been great unrest and discontent amongst the millions of devotees visiting the Pandharpur Temples. Title: Power to Declare Insect Pests, Plant Diseases and Noxious Weeds and Direct Measures to Eradicate or Prevent Them

Title: Procedure Where Measures Prescribed to Eradicate Pests or Plant Diseases Include Removal or Destruction of Plants

Where the preventive or remedial measures directed to be carried out by a notification under section 3 include the removal or destruction of any plant in order to eradicate or prevent the introduction or reappearance of any pest or plant diseases any occupier who fails to remove or destroy such plant on or before the date specified in such notification shall be deemed to have committed an offence under this Act, and the removal or destruction of such plant may be carried out by the Inspecting Officer or under his supervision.

IV-B, p. 2713) In exercise of the powers conferred by sub-section (2) of section 4 of the Bombay Animal Contagious Diseases (Control) Act, 1948 (Bom. LIX of 1948), the Government of Bombay is pleased to appoint all Stockmen in the Animal Husbandry and Veterinary Science Department of the Bombay State to be the Inspectors for all the purposes of the said Act and for the areas within their respective jurisdictions within which they shall exercise the powers and perform the duties of an Inspector under the said Act. G. N., A. & F. D., No. DIS. 1660-G, dated 3rd September, 1960 (M. G., Pt. IV-B, p. 190) In exercise of the powers conferred by sub-section (2) of section 1 of the Bombay Animal Contagious Diseases (Control) (Extension and Amendment) Act, 1960 (Mah. ..... who has been called to treat, an animal which he has reason to believe to be affected with a scheduled disease shall forthwith report the fact to the Inspector having jurisdiction in the area. SECTION 19A: 2[DUTY OF PERSON IN CHARGE TO ISOLATE INFECTIVE ANIMALS Every owner, or person in charge of an animal which he has reason to believe to be affected with a scheduled disease shall keep that animal in a closed space separate from animals not so affected. Explanation:""Closed space" for the purposes of this section means any place, enclosed in such manner, and situated at such distance, as to effectively prevent any animal affected with a scheduled disease from coming into contact with any animal not so affected, or any animal not so affected from coming into contact with an animal so affected.] SECTION 20: KEEPING OR GRAZING INFECTIVE ANIMAL PROHIBITED No person shall keep or graze in open or unenclosed land to which other persons have a right of access for their animals, any animal which he knows to be infective. .....or the village panchayat, in charge of any animal which he or it has reason to believe to be infective of a scheduled disease shall report the fact to the Village Officer or village panchayat in-charge, who may report the same in writing to the nearest available Veterinarian. (2) The Village Officer shall visit the area falling within his jurisdiction for reporting any outbreak of the disease. (3) Every Veterinarian shall, on receipt of a report under sub-sec. (1), or otherwise, if he has reason to believe that any animal is infected with a scheduled disease, report the matter to the Veterinary Officer. (4) Where in any State there is any occurrence of scheduled disease in relation to any animal, the Director shall send an intimation to the Directors of the States which are in the immediate neighbourhood of the place where there is such occurrence, for taking appropriate preventive measures against the spread of the disease. SECTION 5 : Duty to segregate infected animals (1) Every owner or person in charge of an animal, which he has reason to believe is infective of a scheduled disease, shall segregate such animal and have it kept in a place away from all other animals.....
