THE EPIDEMIC DISEASES ACT, 1897 [Act, No. 3 of 1897]1 [AS ON 1957] [4th February, 1897] PREAMBLE An Act to provide for the better prevention of the spread of Dangerous Epidemic Diseases. WHEREAS it is expedient to provided for the better prevention of the spread of dangerous epidemic disease ; It is hereby enacted as follows :-- _________________________ 1. This Act has been amended in its application to-- (1) the Punjab by the Epidemic Diseases (Punjab Amendment) Act, 1944 (Punjab Act 3 of 1944); in East Punjab by East Punjab Act 1 of 1947; (2) the C. P. and Berar by the C. P. and Berar Epidemic Diseases (Amendment) Act, 1945 (C. P. and Berar Act 4 of 1945.)

(1) This Act may be called the Epidemic Diseases Act, 18971. 2[(2) It extends to the whole of India except3 [the territories which, immediately before the 1st November, 1956, were comprised in Part B States.]]4 __________________________ 1. .....any class or section of the public, as he thinks necessary to prevent the outbreak or the spread of the disease: Provided that, where in the opinion of the1[Officer Commanding-in-Chief, the Command], immediate measures are necessary, he may take action without such sanction as aforesaid and, if he does so, shall forthwith report such action to the2[Central Government]. Title: Special Measures in Case of Out-break of Dangerous or Epidemic Diseases

(1) In the event of New Delhi or any part thereof being visited or threatened by an outbreak of any dangerous disease among the inhabitants thereof or any epidemic disease among animals therein, the Chairperson, if he thinks that the other provisions of this Act and the provisions of any other law for the time being in force are insufficient for the purpose, may, with the previous sanction of the Council-- (a) take such special measures; and (b) by public notice, give such directions to be observed by the public or by any class or section of the public; as he thinks necessary to prevent the out break or spread of the disease. Provided that where in the opinion of the Chairperson immediate measures are necessary, he may take action, without such sanction as aforesaid and if he does so, shall forthwith report such action to the Council. (2) No person shall commit a breach of any direction given under sub-section (1) and if he does so he shall be deemed to have committed an offence under section 188 of the Indian Penal Code (45 of 1860).

When the Central Government is satisfied that Indian or any part thereof is visited by, or threatened with, an outbreak of any dangerous epidemic disease and that the ordinary provisions of the law for the time being in force are insufficient to prevent the outbreak of such disease or the spread thereof, the Central Government may take measures and prescribe regulations for the inspection of any ship or vessel leaving or arriving at any port in 1[the territories to which this Act extends] and for such detention thereof, or of any person intending to sail therein, or arriving thereby, as may be necessary. __________________________ 1. Substituted by the Adaptation of Laws (No. 2) order, 1956 for " a part A State or a Part C State".

(1) In the event of a cantonment being visited or threatened by an outbreak of any infectious or contagious disease among the inhabitants thereof or of any epidemic disease among any animals therein, the Officer Commanding the Station, if he thinks that the provisions of this Act or of any law for the time being in force in the cantonment are insufficient for the purpose, may, with the previous sanction of the Central Government-- (a) take such special measures, and (b) by public notice, make such temporary regulations to be observed by the public or by any class or section of the public, as he thinks necessary to prevent the outbreak or the spread of the disease: Provided that where in the opinion of the Officer Commanding the Station, immediate measures are necessary, he may take action without such sanction as aforesaid and, if he does so, shall forthwith report such action to the Central Government. (2) Whoever commits a breach of any temporary regulation made under sub-section (1) shall be deemed to have committed an offence under section 188 of the Indian Penal Code.
