THE TRADING WITH THE ENEMY (CONTINUANCE OF EMERGENCY PROVISIONS) ACT, 1947 [Act, No. 16 of 1947] [AS ON 1955] [20th March, 1947] PREAMBLE An Act to provide for the continuance of certain provisions of the Defence of India Rules relating to the controll of trading with States, and persons and firms belonging to States at war with the Government of India, and the custody of the property belonging to them. WHEREAS it is expedient to provide for the continuance of certain provisions of the Defence of India Rules relating to the control of trading with States, and persons and firms belonging to States at war with the Government of India, and the custody of the property belonging to them; It is hereby enacted as follows :

.....inconsistent therewith contained in any enactment other than this Act or in any instrument having effect by virtue of any enactment other than this Act. SECTION 04: DELEGATIONS (1) The Central Government may by order direct that any power or duty which by or under any of the provisions as continued in force by section 2-is conferred or imposed upon the Central Government, shall in such circumstances and under such conditions, if any, as may be specified in the direction, be exercised or discharged by any officer or authority subordinate to that Government or by any other authority. (3) All orders delegating any power or duty conferred or imposed by any of the provisions continued in force by section 2-made by the Central Government before the commencement of this Act and in force immediately before such commencement shall continue in force and be deemed to be made by the Central Government under this section. SECTION 05: SAVINGS AS TO ORDERS (1) No order made or deemed to be made in exercise of any power conferred by or under any of the provisions continued in force by section 2-shall be called in question in any Court. (2) Where an order purports to have been made and signed.....

Title: Short Title, Extent and Commencement

(1) This Act may be called the Trading with the Enemy (Continuance of Emergency Provisions) Act, 1947. {Subs.by the A.O.1950, for the former sub-section.}[(2) It extends to the whole of India {The words "except Part B States" were rep.by Act 3 of 1951, s.3 and Sch.}; and it applies also to all citizens of India outside India. (3) It shall come into force on the 25th day of March, 1947.

.....conforming to the permitted use has applied the mark, where the purpose and effect of the use of the mark is to indicate, in accordance with the fact, that those services have been performed by the proprietor or a registered user of the mark; (d) the use of a trade mark by a person in relation to goods adapted to form part of, or to be accessory to, other goods or services in relation to which the trade mark has been used without infringement of the right given by registration under this Act or might for the time being be so used, if the use of the trade mark is reasonably necessary in order to indicate that the goods or services are so adapted, and neither the purpose nor the effect of the use of the trade mark is to indicate, otherwise than in accordance with the fact, a connection in the course of trade between any person and the goods or services, as the case may be; (e) the use of a registered trade mark, being one of two or more trade marks registered under this Act which are identical or nearly resemble each other, in exercise of the right to the use of that trade mark given by registration under this Act. Title: Payment to Custodian of Money Otherwise Payable to an Enemy, Enemy Subject or Enemy Firm

.....currency to or for the benefit of an enemy or an enemy subject or an enemy firm (other than cases in which money is payable under a contract in which provision is made for a specified rate of exchange), the payment shall be made to the Custodian in rupee currency at the middle official rate of exchange fixed by the Reserve Bank of India on the date on which the payment became due to that enemy, enemy subject or enemy firm. (3) The Custodian shall, subject to the provisions of section 8, deal with any money paid to him under the Defence of India Rules, 1962, or under this Act and any property vested in him under this Act in such manner as the Central Government may direct. ________________________ 1.
