.....may think fit to make,- (a) that his name has been entered in the register by error or on account of misrepresentation or suppression of a material fact; or (b) that he has been convicted of any offence which, in the opinion of the Council, involves moral turpitude; or (c) that he is an undischarged insolvent; or (d) that he has been adjudged by a competent Court to be of unsound mind. (3) An order under sub-section (2) may direct that any architect whose .name is ordered to be removed from the register shall be ineligible for registration tinder this Act for such period as may be specified. (4) An order under Sub-section (3) shall not take effect until the' expiry of three months from the date thereof. SECTION 30: PROCEDURE IN INQUIRIES RELATING TO MISCONDUCT - (1) When on receipt of a complaint made to it, the Council is of opinion that any architect has been guilty of professional misconduct which, if proved, will render him unfit to practise as an architect, the Council may hold an inquiry in such manner as may be prescribed by rules. THE SIKKIM STATE AUTHORITY FOR PLANNING & DEVELOPMENT ACT, 2007 THE SIKKIM STATE AUTHORITY FOR PLANNING & DEVELOPMENT ACT, 2007 Beit enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows :- CHAPTER I Preliminary Short title, extent and commencement 1 (1). This Act may be called the Sikkim State Authority for Planning and Development Act, 2007. (2) It extends to the whole of Sikkim except the cantonment areas. Explanation I " "cantonment area" means an area within the jurisdiction of a cantonment. Explanation II - "cantonment" has the same meaning as in the Cantonments Act, 1924. (3) It shall come into force on such date as the State Government may, by notification, appoint. 2 of 1924. Definitions. 2. In this Act, unless the context otherwise requires, - (1) "The Advisory Council" means the Advisory Council constituted under section 5; (2) "The Authority" means the Sikkim State Authority for Planning and Development, constituted under section 3; (3) "The Constitution" means the Constitution of India; (4) "The Empowered Executive Committee" means the Empowered Executive Committee constituted under section 4; (5).....

.....Borstal Schools Act, viz., 'an offence for which he is liable to be sentenced to transportation' clearly indicates that the emphasis is not on the factum of punishment but the emphasis is on the 'liability' to be sentenced. Section 6 of the Bombay Borstal Schools Act uses the expression 'liable' with reference to the maximum sentence provided for the offence. In the cases where the maximum sentence provided for the offence is either transportation or imprisonment, etc., then alone section 6 of the Bombay Borstal Schools Act, can apply to such a case. The word 'liable' is normally interpreted to mean, exposed to a certain contingency or causality. In other words, it means a future possibility, probability, happening which may or may not actually occur. It deals with the liability and not with the actual order as to sentence. Merchant Shipping Act, 1958 Complete Act

.....in 1867, 1882andagain in 1893and 1896 but all these attempts failed owing to legal and constitutional difficulties.Two of the principal contributory factors were the then limited powers of the Indian Legislature to legislate regarding shipping and the fact that part of the British Statute law on the subject, including parts of the Merchant Shipping Act, 1894, which is the principal United-Kingdom enactment on the subject, applied to Indian and any Indian enactment had to be in legal harmony with that law. A fresh attempt was made in 1921-22 to codify the Indian law on merchant shipping by the Statute Law Revision Committee, which decided that only consolidation, and not revision should be attempted immediately.
