Educational Institutions (Prohibition of Capitation Fee) Act, 1984 Section 4

Title: Regulation of Admission to Educational Institutions Etc

.....Government from time to time ; (2) In order to regulate the capitation fee charged or collected during the period specified under the proviso to section 3, the Government may, from time to time, by general or special order, specify in respect of each private educational institution or class or classes of such institutions,- (a) the number of seats set apart as Government seats ; (b) the number of seats that may be filled up by the management of such institution,- (i) from among Karnataka students on the basis of merit, on payment of such cash deposits refundable after such number of years, with or without interest as may be specified therein, but without the payment of capitation fee ; or (ii) at its discretion : Provided that such number of seats as may be specified by the Government but not less than fifty per cent of the total number of seats referred to in clauses (a) and (b) shall be filled from among Karnataka students. Explanation.- For the purpose of this section, Karnataka students means persons who have studied in such educational institutions in the State of Karnataka run or recognised by the Government and for such number of years as the Government may.....

Title: Right to Establish a Minority Educational Institution

.....shall, on the grant of a no objection certificate or where the Competent authority has deemed to have granted the no objection certificate, be entitled to commence and proceed with the establishment of a Minority Educational Institution in accordance with the rules and regulations, as the case may be, laid down by or under any law for the time being in force. .....Act),-(i) clause (b) shall be omitted;(ii) for clause (g), the following clause shall be substituted, namely:-'(g) "Minority Educational Institution" means a college or an educational institution established and administered by a minority or minorities;'. 3. Amendment of section 3. - In section 3 of the principal Act, in sub-section (2), for the words "two members", the words "three members" shall be substituted. 4. Amendment of section 10. - In section 10 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:-"(1) Subject to the provisions contained in any other law for the time being in force, any person, who desires to establish a Minority Educational Institution may apply to the competent authority for the grant of no objection certificate for the said purpose.". 5. Amendment of section 12B. - In section 12B of the principal Act, in sub-section (4), the words "and in consultation with the State Government" shall be omitted.V. K.
