Title: Ship and Aircraft Papers to Be Brought in Registry

.....port or aerodrome or any officer designated by the commanding officer or his superior authority as a Prize Officer or such other or person who was present at the capture and saw the ship papers or aircraft papers delivered up or found on board shall make oath that they are brought in as they were taken without fraud, addition, or subduction or alteration or else shall account on oath to the satisfaction of the Prize Court for the absence or altered condition of the ship papers or aircraft papers or any of them. (3) Where no ship papers or aircraft papers are delivered up or found on board the captured ship or captured aircraft, the commanding officer or the captain of the capturing ship or aircraft or the commanding officer of the capturing force or any other officer or person seizing the ship or aircraft or the Prize Officer or such other officer or person who was present at the capture shall make an oath to that effect.

.....specially empowered in this behalf by the Central Government shall perform the safety oversight functions in respect of matters specified in this Act or the rules made thereunder.". 5. Amendment of section 5 In section 5 of the principal Act, (a) in sub-section (1), for the words "The Central Government", the words and figures "Subject to the provisions of section 14, the Central Government" shall be substituted; (b) in sub-section (2), (i) for clause (b), the following clauses shall be substituted, namely: "(b) the licensing, inspection and regulation of aerodromes, the conditions under which aerodromes may be maintained and the prohibition or regulation of the use of unlicensed aerodromes; (ba) the fees which may be charged at those aerodromes to which the Airports Authority of India Act, 1994(55 of 1994) does not apply or is not made applicable;"; (ii) after clause (g), the following clauses shall be inserted, namely: "(ga) the licensing of persons engaged in air traffic control; (gb) the certification, inspection and regulation of communication, navigation and surveillance or air traffic management facilities; (gc) the measures to safeguard civil.....

Title: Power to Detain Aircraft

(1) Any authority authorised in this behalf by the Central Government may detain any aircraft, if in the opinion of such authority-- (a) having regard to the nature of an intended flight, the flight of such aircraft would involve danger to persons in the aircraft or to any other persons or property, or, (b) such detention is necessary to secure compliance with any of the provisions of this Act or the rules applicable to such aircraft; or such detention is necessary to prevent a contravention of any rule made under clause (h) or clause (i) of sub-section (2) of section 5 1[or to implement any order made by any Court.] (2) 2[Subject to the provisions of section 14, the Central Government] may, by notification in the Official Gazette make rules regulating all matters incidental or subsidiary to the exercise of this power. _______________________________ 1. Nothing in this Act shall apply to a ship-of -war or military aircraft of the enemy or any other ship or aircraft owned by the enemy whether or not registered in the territory of the enemy or goods carried therein and no proceedings of prize shall be necessary for the condemnation of such ship-of-war or military aircraft or other ship or aircraft or goods carried therein.

THE FOREIGN AIRCRAFT (EXEMPTION FROM TAXES AND DUTIES ON FUEL AND LUBRICANTS) ACT, 2002 [Act, No. 36 of 2002] [11th June, 2002] PREAMBLE An Act to implement Agreements entered into by India with other countries in pursuance of the Convention on International Civil Aviation opened for signatures at Chicago on the 7th December, 1944. WHEREAS a Convention on International Civil Aviation was signed by India on the 7th December, 1944; AND WHEREAS India, having signed the said Convention, entered into Agreements with the parties to the said Convention to exempt the taxes and duties on fuel and lubricants supplied in India to the aircraft of the contracting parties. BE it enacted by Parliament in the Fifty-third Year of the Republic of India as follows:--
