The Adamas University Act, 2014 Complete Act

.....in the Sixty-fifth Year of the Republic of India, by the Legislature of West Bengal, as follows:- Short title, extent and commencement:- 1. (1) This Act may be called the Adamas University Act, 2014. (2) It shall extend to the whole of the State of West Bengal. (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint. Definitions:- 2. In this Act, unless the context otherwise requires,- (1) Academic Council means the Academic Council of the University; (2) Administrator means the Administrator appointed under this Act by the State Government; (3) Chairman means the Chairman of the Governing Board; (4) Chancellor means the Chancellor of the University; (5) Distance Education means education imparted by a combination of any two or more means of communication like contact programmes, correspondence courses, online courses, broadcasting, telecasting, seminars and any other such methodology; Note.-Through distance education a student is expected to study a course or a part of it without being present physically; (6) Employee means a person appointed by the University to work in the University or its study centres,.....

Whereas sexual harassment results in violation of the fundamental rights of a woman to equality under articles 14 and 15 of the Constitution of India and her right to life and to live with dignity under article 21 of the Constitution and right to practice any profession or to carry on any occupation, trade or business which includes a right to a safe environment free from sexual harassment; And WHEREAS the protection against sexual harassment and the right to work with dignity are universally recognised human rights by international conventions and instruments such as Convention on the Elimination of all Forms of Discrimination against Women, which has been ratified on the 25th June, 1993 by the Government of India; And whereas it is expedient to make provisions for giving effect to the said Convention for protection of women against sexual harassment at workplace. .....exist, in such manner as may be prescribed: Provided that a mere inability to substantiate a complaint or provide adequate proof need not attract action against the complainant under this section: Provided further that the malicious intent on part of the complainant shall be established after an inquiry in accordance with the procedure prescribed, before any action is recommended. (2) Where the Internal Committee or the Local Committee, as the case may be, arrives at a conclusion that during the inquiry any witness has given false evidence or produced any forged or misleading document, it may recommend to the employer of the witness or the District Officer, as the case may be, to take action in accordance with the provisions of the service rules applicable to the said witness or where no such service rules exist, in such manner as may be prescribed. 15. For the purpose of determining the sums to be paid to the aggrieved woman under clause (ii) of sub-section (3) of section 13, the Internal Committee or the Local Committee, as the case may be, shall have regard to " (a) the mental trauma, pain, suffering and emotional distress caused to the aggrieved woman; (b).....

In section 35 of the principal Act and its marginal heading,- (a) for the words "owners of rights", wherever they occur, the words "author and other owners of right" shall be substituted; (b) after sub-section (2), the following sub-sections shall be inserted, namely:- (3) Every copyright society shall have a governing body with such number of persons elected from among the members of the society consisting of equal number of authors and owners of work for the purpose of the administration of the society as may be specified. (4) All members of copyrights society shall enjoy equal membership rights and there shall be no discrimination between authors and owners of rights in the distribution of royalties.

The Haryana State Commission for Women Act, 2012 Complete Act

.....taken in good faith No suit, prosecution or other legal proceeding shall lie against the Chairperson, Vice-Chairperson, any Member of the Commission, or any officer of the Commission for anything which is in good faith done or intended to be done under this Act or the Rules made there under.
