THE UNION TERRITORIES (DIRECT ELECTION TO THE HOUSE OF THE PEOPLE) ACT, 1965 [Act, No. 49 of 1965] [22nd December, 1965] PREAMBLE An Act to provide for direct election in certain Union territories for filling the seats allotted to them in the House of the People and for matters connected therewith. BE it enacted by Parliament in the Sixteenth Year of the Republic of India as follows:-

Title: Direct Election to Fill the Seats in Thehouse of the People Allotted to Certain Union Territories

At the next general election to the House of the People and thereafter, the seats allotted under section 3 of the Representation of the People Act, 1950(43 of 1950) to the Union territories in the House of the People shall be seats to be filled by persons chosen by direct election and for that purpose each Union territory shall form one parliamentary constituency.

.....the Republic of India as follows: SECTION 01: SHORT TITLE This act may be called the union territories (direct election to the house of the people) act, 1965. SECTION 02: DEFINITIONS In this Act - (a) parliamentary constituency' has the same meaning as inthe Representation of the People Act, 1950-; (b) "sitting member" means a person who immediately before the commencement of this Act is a member of the House of the People - (c) "Union territory" means any of the Union territories of the Andaman and Nicobar Islands, the Laccadive, Minicoy and Amindivi Islands and Dadra and Nagar Haveli. SECTION 03: DIRECT ELECTION TO FILL THE SEATS IN THE HOUSE OF THE PEOPLE ALLOTTED TO CERTAIN UNION TERRITORIES At the next general election to the House of the People and thereafter, the seats allotted under section 3 of the Representation of the People Act, 1950-to the Union territories in the House of the People shall be seats to be filled by persons chosen by direct election and for that purpose each Union territory shall form one parliamentary constituency. SECTION 04: AMENDMENT OF ACT 43 OF 1950 [Repealed by the Repealing and Amending Act, 1974 (56 of 1974), S. 2 and Ist, Sch. (20-12-1974).].....

Prior to Repeal S.4 stood as follows "In the Representation of the People Act, 1950,- (a) in sub- section (1) of section 4, the words ", to the Andaman and Nicobar Islands, to the Laccadive, Minicoy and Amindivi Islands, to Dadra and Nagar Haveli," shall be omitted; (b) in sub- section (1) of section 13B, for the words "each parliamentary constituency in the Union territory of Delhi,", the words "a parliamentary constituency in each of the Union territories of Delhi, the Andaman and Nicobar Islands, the Laccadive, Minicoy and Amindivi Islands and Dadra and Nagar Haveli," shall be substituted; (c) in sub- section (1) and sub- section (2) of section 13D, for the words "the Union territory of Delhi", the words "each of the Union territories of Delhi, the Andaman and Nicobar Islands, the Laccadive, Minicoy and Amindivi Islands and Dadra and Nagar Haveli" shall be substituted."

Union Territories (Direct Election to the House of the People) Act, 1965 Section 6

Title: Provision as to Sitting Member

Year: 1965

The sitting member representing each Union territory shall continue to represent that Union territory until the dissolution of the present House of the People and if before such dissolution the seat allotted to a Union territory in the House of the People becomes vacant it shall be filled by a person nominated by the President and that person shall represent the Union territory in the present House of the People until its dissolution.

Title: Calculation of Direct Tax Payable by the Employer

.....Act; (iii) any exemption conferred on the employer under section84 of the Income-tax Act or of anydeduction to which he is entitled under subsection (1) of section, 101 of that Act, as in force immediatelybefore the commencement of the Finance Act, 1965 (10 of 1965); (b) where the employer is a religious or a charitable institutionto which the provisions of section 32 do not apply and the whole or any part of its income is exemptfrom tax under the Income-tax Act, then, with respect to the income soexempted, such institution shall be treated as if it were a company in whichthe public are substantially interested within the meaning of that Act; (c) where the employer is individual or a Hindu Undivided Family,the tax payable by such employer under the Income-tax Act shall be calculatedon the basis that the income derived by him from the establishment is his only income; (d) where the income of any employer includes any profits andgains derived from the export of any goods or merchandise out of India and any rebate on such income inallowed under any law for the time being in force relating to direct taxes,then, no account shall be taken of such rebate; (e) no account.....
