Multi State Co-operative Societies Act, 1984 [Repealed] Repealing Act 1

Title: Multi-state Co-operative Societies Act, 2002

.....shall apply to-- (a) all co-operative societies, with objects not confined to one State which were incorporated before the commencement of this Act,-- (i) under the Co-operative Societies Act, 1912, 2 OF 1912 or (ii) under any other law relating to co-operative societies in force in any State or in pursuance of the Multi-unit Co-operative Societies Act, 1942, 6 of 1942 or the Multi-State Co-operative Societies Act, 1984, 51 of 1984, and the registration of which has not been cancelled before such commencement; and (b) all multi-State co-operative societies. 3. Definitions In this Act, unless the context otherwise requires,-- (a) "area of operation" means the area from which the persons are admitted as members; (b) "board" means the board of directors or the governing body of a multi-State co-operative society, by whatever name called, to which the direction and control of the management of the affairs of the society is entrusted; (c) "bye-laws" means the bye-laws for the time being in force which have been duly registered or deemed to have been registered under this Act and includes amendments thereto which have been duly registered or deemed to have been.....

.....to pay a fine awarded by a criminal Court, a court-martial exercising jurisdiction under section 71, or an officer exercising authority under section 82 or section 90. Title: Pay and Allowances Daring Trial

In the case of any person subject to this Act who is in custody or under suspension from duty on a charge for an offence, the prescribed officer may direct that the whole or any part of the pay and allowances of such person shall be withheld, pending the result of his trial in the charge against him, in order to give effect to the provisions of clause (b) of sections 91 and 92.

Multi-state Co-operative Societies Act, 2002 Chapter V

Title: Direction and Management of Multi-state Co-operative Societies

(3) The board shall consist of such number of directors as may be specified in the bye-laws: Provided that the maximum number of directors in no case shall exceed twenty-one: Provided further that the board may co-opt we directors in addition to twenty-one directors specified in the first proviso: Provided also that the functional directors in the national co-operative societies shall also be the members of the board and such members shall be excluded for the purpose of counting the total number of directors specified in the first proviso. Section 42 - Association of employees in management decision making process Every multi-State co-operative society shall devise such procedure, as may be specified in the bye-laws.....

Multi-state Co-operative Societies Act, 2002 Section 43

Title: Disqualifications for Being a Member of Board

.....behalf of or against any other multi-State co-operative society which is a member of the former society. Explanation.-- For the purposes of this clause, "legal practitioner" has the same meaning as in clause (i) of sub-section (1) of section 2 of the Advocates Act, 1961; (j) has been convicted for any offence under this Act; (k) is disqualified for being a member under section 29; (l) has been expelled as a member under section 30; (m) absents himself from three consecutive board meetings and such absence has not been condoned to by the board; (n) absents himself from three consecutive general body meetings and such absence has not been condoned by the members in the general body. (2) A person shall not be eligible for being elected as member of board of a multi-State co-operative society for a period of five years if the board of such multi-State co-operative society fails-- (a) to conduct elections of the board under section 45; or (b) to call the annual general meeting under section 39; or (c) to prepare the financial statement and present the same in the annual general meeting.

Section 44 - Facilities for sitting (1) In every factory suitable arrangements for sitting shall be provided and maintained for all workers obliged to work in a standing position, in order that they may take advantage of any opportunities for rest which may occur in the course of their work. (2) If, in the opinion of the Chief Inspector, the workers in any factory engaged in a particular manufacturing process or working in a particular room are able to do their work efficiently in a sitting position, he may, by order in writing, require the occupier of the factory to provide before a specified date such seating arrangements as may be practicable for all workers so engaged or working. (3) The State Government may, by notification in the Official Gazelle, declare that the provisions of sub-section (1) shall not apply to any specified factory or class or description of.....

Bird and Company Limited (Acquisition and Transfer of Undertakings and Other Properties) Act, 1980 Complete Act

Bird and Company Limited is a lading company in a group of 23 other companies engaged in manufacturing, mining, trading and investment activities. While two of the companies are subsidiaries of the Company, the other companies in the group are under varying degrees of control of the company through its direct shareholding or by shareholding by the investment companies in the group. The Company provides marketing and management services to some of the group companies. The manufacturing companies in the group are engaged in production of goods which are vital to the needs of' the country. There had been .several allegations against the management of some of these companies indicating misuse of the companies, mismanagement, misfeasance or malfeasance. The Company Law Board ordered investigations in 1977 under section 237 (b) of the Companies Act, 1956, in respect of some of these companies. Four of the companies have already been nationalised.
