Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 Complete Act

.....the advertisement for certain purposes of remedies alleged to possess magic qualities and to provide for matters connected therewith. Be it enacted by Parliament as follows :- Act extended to Sikkim with modifications w.e.f. 1-11-89 - See Gaz. of Ind., 20-10-88 and 26-10-89, Pt. II, S. 3(ii), Ext., p. 3 (No. 533) and p. 2 (No. 691). The Act has been extended to the Union territory of- (1) Dadra and Nagar Haveli by Regn. 6 of 1963 (1-7-1965); (2) Pondicherry by Regn. 7 of 1963 (1-10-1963); and (3) Goa, Daman and Diu by Regn. 11 of 1963 (1-7-1965). (Goa is now a State). SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be calledthe Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954-. (2) It extends to the whole of India except the State of Jammu and Kashmir, and applies also to persons domiciled in the territories to which this Act extends who are outside the said territories. (3) It shall come into force on such date1as the Central Government may, by notification in the Official Gazette, appoint. SECTION 02: DEFINITIONS - In this Act, unless the context otherwise requires,- (a) "advertisement" includes any notice, circular, label, wrapper,.....

No person shall import into, or export from, the territories to which this Act extends any document containing an advertisement of the nature referred to in Sec. 3 or in Sec. 4 or Sec. 5, and any document containing any such advertisements shall be deemed to be goods of which the import or export has been prohibited under Sec. 19 of the Sea Customs Act, 1878 (8 of 1878),1and all the provisions of that Act shall have effect accordingly, except that Sec. 1832thereof shall have effect as if for the word "shall" therein the word "may" were substituted. ________________________ 1. Taxation Laws (Extension to Jammu and Kashmir) Act, 1954 Complete Act

.....as a reference to the corresponding officer, authority, tribunal or Court appointed or constituted by or under the corresponding Act, rule or order now extended to the State, and if any question arises as to who such corresponding officer, authority, tribunal or Court is, the decision of the Central Government thereon shall be final. SECTION 08: REMOVAL OF DIFFICULTIES If any difficulty arises in giving effect to any of the provisions of any of the Acts, rules or orders now extended to the State of Jammu and Kashmir, the Central Government may, by order3 published in the Official Gazette make such provision or give such direction as appears to it to be necessary for removing the difficulty. Save as otherwise provided in section 6 the following laws are hereby repealed namely : (a) the Matches (Excise Duty) Act, Svt. 1992 (4 of Svt. 1992). (b) the Mechanical Lighters (Excise Duty) Act, Svt. 1992 (5 of Svt. 1992). (c) the Sugar (Excise Duty) Act, Svt. 2000 (6 of Svt. 2000). (d) the Tobacco (Excise Duty) Ordinance, Svt. 2001 (5 of Svt. 2001). (e) the Income-tax Act, Svt. 2007 (10 of Svt. 2007), and (f) the Jammu and Kashmir Customs Act, Svt. 1958, with the exception of the following provisions namely : (i) section 25 in so far as it authorises the State Government to prohibit the importation or exportation of newspapers or books as defined in the Jammu and Kashmir State Press and Publications Act of Svt. 1989. (ii) sections 25A, 25B and 25C, and (iii) any other provision contained in the said Act which may be necessary or relevant for thepurpose of carrying into effect the provisions contained in the sections referred to in sub-clauses (i) and (ii).

.....to have effect for the purposes of the levy assessment and collection of income-tax and super-tax or for the purposes of any penalty, interest, composition-fee or any other demand under that Act in respect of any period prior to the previous year for the purposes of assessment under the Indian Income-tax Act, 1922, for the year ending on the 31st day of March, 1955. (2) Without prejudice to the provisions contained in sub-section (1) and subject thereto, section 6 of the General Clauses Act, 1897 shall apply in relation to the repeal of any of the laws referred to in section 5 as if the law so repealed had been an enactment within the meaning of section 6 of that Act.

.....cases. 3. The present Bill seeks to achieve these objects.-Gaz. of Ind., 3-8- 19S9, Pt. II, S. 2, Ext., P. 579. Amending Act 34 of 1964.- The Wakf Act, 1954 was enacted to provide for the better administration and supervision of wakfs. The Act was amended in 1959 for the limited purpose of removing certain difficulties arising out of reorganisation of States. Experience of the working of the Act over the last ten years has revealed certain difficulties. It is, therefore, proposed to amend the Act to remove these difficulties and to ensure better administration of wakfs by mutawallis, 2. The main features of the Bill are: (i) The definition of beneficiary in regard to objects of public utility is being broadened to cover all objects obtained by Muslim law. Endowments made by nun-Muslims for support of certain Muslim religious and pious institutions will also come under the purview of the Act. (ii) A Central Wakf Council is proposed to be established. (iii) A provision is being made to enable the establishment of separate Sunni and Shia Boards in any State in which the Shia Wakfs constitute in number more than fifteen per cent. of the total number of wakfs In that State or the.....
