Title: Export Development Fund

.....Export Development Fund shall be credited- (a) all amounts received for the purposes of that Fund by way of loans, gifts, grants, donations or benefactions from Government or any other source in or outside India; (b) repayments or recoveries in respect of loans, advances or other facilities granted from the Fund; (c) income or profits from investments made from the Fund; and (d) income accruing or arising to the Fund by way of interest or otherwise, on account of the application of the Fund in accordance with the provisions of section 17. Section 17 - Utilisation of Export Development Fund (1) Where the Exim Bank considers it necessary or desirable so to do, it may, subject to the provisions of sub-sections (2) and (3), disburse or spend from the Export Development Fund any amount an account or in consequence of the grant of any loan or advance, or on account or in consequence of entering into any arranagement under sub-section (1) or clause (b) or clause (c) or clause (d) or clause (q) or clause (r) or clause (s) or clause (w) or clause (x) of sub-s. .....2.-- In the Agricultural and Processed Food Products Export Development Authority Act, 1985(2 OF 1986) (hereinafter referred to as the principal Act), in section 2,-- (a) in clause (g), for the words "Scheduled products", the words "Scheduled products or, as the case may be, Special products" shall be substituted; (b) in clause (i), for the words "the Schedule", the words "the First Schedule" shall be substituted; (c) after clause (i), the following clause shall be inserted, namely:-- (j) "Special product" means any of the agricultural or processed food products included in the Second Schedule.'. 3. Substitution of new section for section 3 For section 3 of the principal Act, the following section shall be substituted, lamely:-- "3. Power to amend the Schedule - The Central Government may, having regard to the objects to this Act, and if it considers necessary or expedient so to do, by notification in the Official Gazette, add to, or, as the case may be, omit from, the First Schedule or the Second Schedule any agricultural or processed food product and on such addition, or as the case may be, omission, such product shall be, or shall cease to be, a Scheduled.....

Title: Utilisation of Export Development Fund

(3) The Central Government shall, before giving its approval, satisfy itself that such loan, advance or arrangement is necessary as a matter of priority in the interests of the international trade of the country. (4) For the removal of doubts, it is hereby declared that nothing contained in this section shall be deemed to preclude the Exim Bank from granting any loan or advance or from entering into any arrangement under sub-s. (1) or clause (b) or clause (c) or clause (d) or clause (q) or clause (r) or cl. (s) or clause (w) or clause (x) of sub-section (2) of section 10 without the approval of the Central Government, if no amount in respect thereof is to be disbursed or spent from the Export Development Fund.

Agricultural and Processed Food Products Export Development Authority Act, 1985 Section 19

Title: Power to Prohibit or Control Imports and Exports of Scheduled Products

(1) The Central Government may, by order published in the Official Gazette, make provision for prohibiting, restricting or otherwise controlling the import or export of the Scheduled products, either generally or in specified classes of cases. (2) All Scheduled products to which any order under sub-section (1) applies, shall be deemed to be goods of which the export has been prohibited under Section 11 of the Customs Act, 1962 (52 of 1962), and all the provisions of that Act shall have effect accordingly. (3) If any person contravenes any order made under sub-section (1), he shall, without prejudice to any confiscation or penalty to which he may be liable under the provisions of the Customs Act, 1962 (52 of 1962), as applied by sub-section (2), be punishable with imprisonment for a term which may extend to one year, or with fine, or with both.

Sugar Export Promotion Act, 1958 Section 5

Title: Export Quotas for Factories

The Central Government shall by order in writing, apportion the quantity of sugar fixed from time to time for purposes of export under section 4 among the owners in proportion to the quantity of sugar produced, or likely to be produced, by them respectively during the season referred to in sub-section (2) of section 4, and such order shall be communicated to each of the owners, and the quantity so apportioned shall be deemed to be the export quota for the factory of that owner.

Sugar Export Promotion Act, 1958 Section 8

Title: Sale by Export Agency of Sugar Delivered

(1) The export agency shall take all practical measures to export sugar delivered to it under this Act: Provided that if the export agency is of opinion that having regard to the quality of the sugar delivered to it by any owner, or to the expenses involved in transporting the sugar from one place to another or to the delay likely to be involved in exporting it, or to the conditions prevailing in the markets for sugar, whether in or out of India or to any other relevant circumstances, it is expedient so to do, the export agency may sell the whole or any part of the sugar in India and may, if it thinks fit, purchase such quantity of sugar as it may consider necessary for export at the appropriate time. (2) For the purposes of sub-section (1), the export agency may itself sell sugar or permit the owner to sell the whole or any part of the export quota in his custody at a price approved by it on condition that the sale proceeds are payable to it.
