This Act now incorporates the provisions contained therein in the Banking Companies Act. 1949 as a pernabebt basis, in addition. this Act also amends the said Act for the following purposes :- (a) to incorporate special provisions for facilitating quick amalgamations between banking companies: (b) to empower the Reserve Bank to control opening of branches by Indian banks in foreign countries: (c) to provide a meaning of the terms "assets in India" for the purpose of section 25.-Gaz. of Ind.. 24-12-1949. Pt. V. p:501. Act 52 of 1953.- The Banking Companies Act. 1949 (X of 1949) was passed to ensure proper administration of the banking companies in India. The liquidation of banks, however, continued to be governed by the provisions of the Indian Companies Act, 1913. Experience of the liquidation of a large number of banks that failed during the post-war and post-partition period disclosed that the procedure for the liquidation of joint stock companies was totally inadequate for the liquidation of banking companies in a manner satisfactory to the depositors. .....intoxicating substance which the 4[State] Government may by notification in the Official Gazette, declare to be liquor for the purposes of this Act; (25) "manufacture" includes- (a) even, process whether natural or artificial by which any liquor or intoxicating drug is produced, prepared or blended and also redistillation and every process for the 5 [rectification, flavouring. Title: Import, Export, Etc. of Intoxicant by Any Person on Account of Another

(1) Whenever any intoxicant, hemp, mhowra flowers or molasses are manufactured, imported, exported, transported, sold, or are possessed by any person on account of any other person and such other person knows or has reason to believe that such manufacture, import, export, transport, sale or possession is, on his account, the intoxicant, hemp, mhowra flowers or molasses, as the case may be, shall, for the purposes of this Act, be deemed to have been manufactured, imported, exported, transported or sold by or to be in possession of, such other person. (2) Nothing in Sub-section (1) shall absolve any person from liability to any punishment under this Act for the unlawful manufacture, import, export, transport, sale or possession of such articles.

Title: Provisions of This Act Not to Apply to Import or Export Across Customs Frontier

Title: Control of Export, Etc. of Molasses

(1) Except as otherwise provided in Sub-sections (2) and (3), no person shall export, import, transport, sell or have in his possession any quantity of molasses. (2) The1[State] Government may, by general or special order, authorise any Collector2[or any other officer]to grant licences for the import,export,saleor possession of molasses. (3) The1[State] Government may also authorise any Collector or any other officer to grant permits for the transport of molasses. _______________________ 1. Title: Prohibition of Export, Import, Transport, Sale, Manufacture, Etc. of Intoxicating Drugs

No person shall- (a) export, import, transport or possess any intoxicating drug; (b) cultivate or collect the hemp1* * (c) use keep or have in his possession any materials, still, utensils, implements or apparatus whatsoever for the manufacture of any intoxicating drug; (d) sell or buy any intoxicating drug; (e) consume or use any intoxicating drug; or (f) manufacture any intoxicating drug. ______________________ 1. Title: Prohibition of Import, Export, Transport, Sale, Etc. of Sweet Toddy

Title: Booked depositors' credits to be deemed proved

Booked depositors' credits to be deemed proved.- In any proceeding for the winding up of a banking company, every depositor of the banking company shall be deemed to have filed his claim for the amount shown in the books of the banking company as standing to his credit and, notwithstanding anything to the contrary contained in2[section 474 of the Companies Act, 1956 (1 of 1956)], the High Court shall presume such claims to have been proved, unless the official liquidator shows that there is reason for doubting its correctness.] ______________________ 1. .....of this Constitution if- (a) he or either of his parents or any of his grand- parents was born in India as defined in (Government of India Act, 1935) (as originally enacted); and (b) (i) in the case where such person has so migrated before the nineteenth day of July, 1948. he has been ordinarily resident in the territory of India since the date of his migration, or (ii) in the case where such person has so migrated on or after the nineteenth day of July, 1948, he has been registered as a citizen of India by an officer appointed in that behalf by the Government of the Dominion of India on an application made by him therefor to such officer before the commencement of this Constitution in the form and manner prescribed by that Government : Provided that no person shall be so registered unless he has been resident in the territory of India for at least six months immediately preceding the date of his application.
