Rubber Act, 1947 Section 12

Title: Imposition of New Rubber Cess

.....by the Board in accordance with rules made in this behalf either from the owner of the estate on which the rubber is produced or from the manufacturer by whom 3[such rubber is used or from the exporter by whom such rubber is exported:] 4[Provided that the Central Government may, if considered necessary in the public interest, by order for reasons to be recorded in writing, exempt or reduce the duty of excise on rubber exported on such terms and conditions as it deems fit: Provided further that the Central Government may, by notification in the Official Gazette, specify zero paisa per kilogram as the rate of duty of excise on natural rubber produced in India and procured for export by the exporters of natural rubber for the period from the 1st April, 1961 to the 31st August, 2003.] 5[(3) Subject to the provisions of this Act, every owner, exporter or the manufacturer, as the case may be, shall pay the duty of excise to the Board in the manner and for the period referred to in sub-section (4) and, if he fails to do so, the duty may be recovered with the cost of collection and interest at such rates, as may be prescribed, from the owner, exporter or the manufacturer, as.....

.....development under the control of the Union of the rubber industry. It is hereby enacted as follows:- SECTION 01: SHORT TITLE AND EXTENT (1) This Act may be called The Rubber Act,3[* * *] 1947. (2) It extends to the whole of India4[except the State of Jarnmu and Kashmir.] SECTION 02: DECLARATION AS TO EXPEDIENCY OF UNION CONTROL It is hereby declared6that it is expedient in the public interest that the Union should take under its control the rubber industry. SECTION 03: DEFINITIONS In this Act, unless there is anything repugnant in the subject or context (a) "Board" means the 7[***] Rubber Board constituted under this Act; (b) "dealer", means any person who deals in rubber, whether wholesale or retail or holds stocks of rubber, and includes the representative or agent of a dealer; (c) "estate" means any area administered as one unit which contains land planted with rubber plants 8[(cc) "Executive Director", means the Executive Director appointed under this Act;] (d) "export" and "import", mean respectively taking out of, and bringing into9[India] by sea, lane or air; 10[(dd) "India" means the territory of India excluding the State of Jammu and Kashmir;] (e) "manufacturer".....

Title: Power to Prohibit or Control Imports and Exports of Rubber

(1) The Central Govern­ment may,1[* * *] by order published in the official Gazette, make provision for prohibiting, restricting or otherwise controlling the import or export of rubber, either generally or in specified classes of cases. (2) All goods to which any order under sub-section (1) applies shall be deemed to be goods of which the import or export has been prohibited or restricted under section 19 of the Sea Customs Act, 1878, and all the provisions of that Act shall have effect accordingly, except that section 183 thereof shall have effect as if for the word "shall" therein the word "may" were substituted. (3) If any person contravenes any order made under sub-section (1), he shall, without prejudice to any confiscation or penalty to which he may be liable under the provisions of the Sea Customs Act, 1878, as applied by sub-section (2), be punishable with imprisonment for a term which may extend to one year or with fine or with both. _______________________ 1. Title: Dismissal, Etc., of an Individual Workman to Be Deemed to Be an Industrial Dispute

S. 9 (1 )(a) (1-11-1956). The Act now extends to the Union Territories of- (1) Goa. Daman and Din - -see Regn. 12 of 1962 (24- 1-1963). [Goa is now a State - See Act 18 of 1987. S.3 (30-5-1987). (2) Dadra and Nagar Haveli - Act as in force in the State of Gujarat is extended to this territory with effect from 1-1- 1966 - See Gazette of India. 18-12-65. Pt. II. S. 3(l). p. 2016. .....wishes which are merely spiritual or religious in nature), whether or not,- (i) any capital has been invested for the purpose of carrying on such activity; or (ii) such activity is carried on with a motive to make any gain or profit, and includes- (a) any activity of the Dock Labour Board established under section 5A of the Dock Workers (Regulation of Employment) Act, 1948 (9 of 1949) ; (b) any activity relating to the promotion of sales or business or both carried on by an establishment, but does not include- (1) any agricultural operation except where such agricultural operation is carried on in an integrated manner with any other activity (being any such activity as is referred to in the foregoing provisions of this clause) and such other activity is the predominant one.
