Karnataka Prohibition of Beggary Act, 1975 Section 13

Title: Infirm, Disabled and Decrepit Beggars and Persons Suffering from Any Incurable Disease to Be Arrested and Sent to Receiving Centres

.....of arrest to the court of such magistrate: Provided that no person arrested shall be detained in the custody beyond a period of twenty-four hours without the authority of a magistrate. (2) Where a person who is produced under subsection (1) before a magistrate is found on enquiry by such magistrate to have contravened the provisions of section 3, the magistrate shall convict him and pass sentence of detention in the nearest relief centre for such period1[which shall not be less than one year but which may extend to three years] as may be specified in the order and an order of detention passed by a magistrate may at any time be revoked or modified by such magistrate. _______________________________ 1. .....of arrest to the court of such magistrate and the magistrate shall, after satisfying himself that the said person has contravened the provisions of section 15, order him to be delivered to the institution with a warning. (3) Any person dealt with under the provisions of sub-section (1), who absconds or takes to begging after he is discharged under section 15 shall be placed before a Judicial Magistrate, or Metropolitan Magistrate who after summary trial may convict him and sentence him to imprisonment for a period not exceeding three months. Section 17 - Abettors to be punished with imprisonment or fine or both Whoever employs any person to beg or abets such employment, shall be punished on conviction by a magistrate with simple or rigorous imprisonment for a term which may extend to three months or with fine, which may extend to three hundred rupees or with both. .....NOT CLAIMED WITHIN WEEK - If the cattle be not claimed within seven days from the date of their being impounded, the poundkeeper shall report the fact to the officer in charge of the nearest police station or to such other officer as the Magistrate of the District appoints in this behalf. Such officer shall thereupon stick up in a conspicuous part of his office a notice staling- (a) the number and description of the cattle. (b) the place where they were seized. (c) the place where they are impounded. and shall cause proclamation of the same to be made by beat of drum in the village and at the market-place nearest to the place of seizure. If the cattle be not claimed within seven days from the date of the notice, they shall be sold by public auction by the said officer, or an officer of his establishment deputed for that purpose, at such place and time and subject to such conditions as the Magistrate of the District by general or special order from time to time directs: Provided that, if any such cattle are, in the opinion of the Magistrate of the District, not likely to fetch a fair price if sold as aforesaid, they may be disposed of in such manner as he thinks fit. (2) When any certificate is issued in any of the circumstances specified in rule 4, sub-rule (2), it shall state on the face of it and against the stub or counterfoil to the effect that it is "Issued in lieu of share certificate No ______ sub-divided/replaced/on consolidation of shares". (3) When any certificate is issued in any of the circumstances specified in rule 4, sub-rule (3), it shall state on the face of it and against the stub or counterfoil to the effect that it is a "duplicate issued in lieu of share certificate No. _______ ". Further, the word "duplicate" shall be stamped or punched in bold letters across the face of the share certificate. 6. Sealing and signing of certificate.- Every share certificate shall be issued under the seal of the company, which shall be affixed in the presence of (i) two directors or persons acting on behalf of the directors under a duly registered power of attorney; and (ii) the secretary or some other person appointed by the Board for the purpose. The two directors or their attorneys and the secretary or other person shall sign the share certificate: Provided.....
