Goa, Daman and Diu Mining Concessions (Abolition and Declaration as Mining Leases) Act, 1987 Complete Act

.....1987 16 of 1987 23rd May, 1987 After Goa, Daman and Diu became part of India, the provisions of the Mines and Minerals (Regulation and Development) Act 1957(1957 Act) except section 16 were extended to that Union territory with effect from 1-10-1963 and section 16 was extended with effect from 15-1-1966. The Controller of Mining Leases in exercise of the powers conferred on him under section 16 of the Act, proceeded with the modification of the mining concessions granted under the earlier Portuguese Mining Laws of 1906 so as to bring them in conformity with the provisions of the 1957 Act. The concession holders challenged the proceedings of the Controller on the ground that the concessions held by them were not existing mining leases within the meaning of the provisions of the 1957 Act, The Bombay High Court in its judgment dated 29-9-1983 held that the concessions were not mining leases within the meaning of 1957 Act. As a result of this judgment, the Controller of Mining Leases could not take further action to modify the concessions. The High Court in another case held that no royalty could be charged on the minerals extracted by the concession holder, as such mining.....

THE ORISSA SERVICE OF ENGINEERS (VALIDATION OF APPOINTMENT) ACT, 2002 THE ORISSA SERVICE OF ENGINEERS (VALIDATION OF APPOINTMENT) ACT, 2002 Orissa Act 9 of 2003 [Received the assent of the Governor on the 5th February 2003, first published in an extraordinary issue of the Orissa Gazette, dated the 15th, February, 2003 (No. 218)] An act to validate the ad hoc appointment of certain assistant engineers made to the Orissa Service of Engineers. Be it enacted by the Legislature of the State of Orissa in the Fifty-third Year of the Republic of India as follows:- 1. Short title. This Act may be called the Orissa Service of Engineers (Validation of Appointment) Act, 2002. 2. Definitions. In this Act unless the context otherwise requires- (a) "Government" means Government of Orissa; (b) "Recruitment .Rules" means the Orissa Service of Engineers Rules, 1941; (c) "Service" means the Orissa Service of Engineers; and (d) "Year" means the Calendar Year. 3. Validation. (1) Notwithstanding anything contained in the Recruitment Rules, seven hundred ninety-nine Assistant Engineers belonging to the discipline of Civil, fifty-seven Assistant Engineers.....

Arya Marriage Validation Act, 1937 Complete Act

.....as introduced, (now appearing as Cl, 2). We have omitted the definition of Arya Samajists. We were impressed by the difficulty of finding a satisfactory definition, and we consider that the proposal in sub-clause (b) of Cl. 2 that a declaration subsequent to marriage should suffice to establish that the maker of the declaration was an Arya Samajist, was fraught with danger. We are of opinion that the purposes of the Bill will be adequately served if the question of the religious status of the parties to a marriage remains a question of fact to be determined by the circumstances of each case. We have recast clause (3) (now numbered Cl. 2) in a clearer and more comprehensive form. We recognize that some provision must be made to govern succession in respeet of the marriages dealt with by the Bill, but we found that considerable diversity of opinion existed as lo what that provision should be. We decided by a majority that the most suitable solution of the problem is to provide as we have done in clause 3 that questions of succession shall be determined according to the Indian Succession Act, '1925.
