Indian Red Cross Society Act, 1920 Section 2

Title: Constitution of India Red Cross Society

Thereshall be constituted by this Act a Society to be known as the Indian Red CrossSociety (hereinafter called the Society). The first members of the Societyshall be nominated by persons who immediately before the commencement of thisAct were members of the Joint War Committee, Indian Branch, of the Order of St.John of Jerusalem in England and the British Red Cross Society (hereinaftercalled the Committee) at a meeting to be summoned and held for that purpose inaccordance with the usual practice of the Committee within three months from thecommencement of this Act. The number of members to be so nominated shall not beless than twenty-five or more than fifty.

Title: Cesser of Provisions of Indian Red Cross Society Act, 1920

On the making of the vesting order referred to in section 3 the provisions of the Indian Red Cross Society Act,1920, (15 of 1920) and of any rules made there under relating to Branch Committees in the States, their constitution, powers or functions, their representation on the Managing Body of the Indian Red Cross Society, and their right to receive a proportion of the income of property vested in the Society, shall cease to have effect in respect of the Province of Burma and of the Indian Red Cross Society, Burma Branch Committee.

Title: Transfer of Property to Pakistan

1[13. Transfer of property to Pakistan.-- (1) Notwithstanding anything contained in this Act, the Managing Body may, from out of the funds specified in column 1 of the Third Schedule, transfer to the Pakistan Red Cross Society the amounts specified in that Schedule as being the share of the Pakistan Red Cross Society which that Society has agreed to receive for being applied to the purposes for which they were held by the Society. (2) Upon the transfer of such amounts to the Pakistan Red Cross Society under sub-section (1), the Society shall be freed and discharged from all obligations imposed upon it by or under this Act as in force before the commencement of the Indian Red Cross Society (Amendment) Act, 1956, or under any trust or other document in respect of anything to be done in Pakistan or in any part thereof.] _____________________________ 1. Red Cross Society (Allocation of Property) Act,1936 Section 3

Title: Transfer of Apportioned Property to Trustees and Dissolution of Burma Branch Committee of Indian Red Cross Society

As soon as the High Court of Judicature at Rangoon has settled a scheme and made an order vesting the Fund in the body of trustees referred to in section 2 the Managing Body of the Indian Red Cross Society shall transfer the Fund to the said body of trustees and thereupon the Burma Provincial Committee of the Indian Red Cross Society, known as the Indian Red Cross Society, Burma Branch, shall be dissolved and all property of or belonging to that Committee, including the unexpended balance, if any, of any moneys distributed to that Committee under section 8 of the Indian Red Cross Society Act,1920, (15 of 1920) shall be transferred to and shall vest in the said body of trustees to be held by them in the same manner and, subject to the scheme settled by the said High Court, for the same purposes as such property was held by that Committee.

Red Cross Society (Allocation of Property) Act,1936 Section 2

Title: Apportionment of Corpus of Property of Indian Red Cross Society

Notwithstanding anything contained in the Indian Red Cross Society Act, 1920, (15 of 1920) an amount equal to seven per cent, of the corpus of the property vested by the said Act in the Indian Red Cross Society (which amount is in this Act referred to as the Fund) shall be set a part to be administered in the Province of Burma as a trust by such body of trustees as the High Court of Judicature at Rangoon may appoint, and in accordance with, and for such of the purposes referred to in section 7 of the said Act as may be contained in, any scheme settled by the said High Court.

Indian Red Cross Society Act, 1920 Section 4

The first members of the Society and all persons who may hereafter become members thereof so long as they continue so to be, are hereby constituted a body corporate under the name of the Indian Red Cross Society, and the said body shall have perpetual succession and a common seal with power to hold and acquire property, moveable and immoveable, and shall sue and be used by the said name.

Title: Power to Make Rules

.....of the Society; (j) the regulation of the procedure generally of the Society and Managing Body. (2) The Central Government shall cause every rule made under this section to be laid as soon as may be after the rule is made before each House of Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately, following the session or the successive sessions aforesaid, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, that rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule". _____________________________ 1. Indian Red Cross Society Act, 1920 Section 4C

Title: Secretary General and Treasurer of the Society

(1)The Managing Body shall, with the previous approval of the President, appoint a Secretary-General and a Treasurer of the Society. (2) The term of office and the conditions of service of the Secretary-General and the Treasurer shall be such as the Managing Body may determine by rules made under section 5 : Provided that the term of office and conditions of service of the Secretary-General and the Treasurer may be varied in like manner by the Managing Body. (3) Notwithstanding anything contained in any contract or agreement and notwithstanding any judgment, decree or order of any court, tribunal or authority or anything contained in any other provision of this Act or the rules made thereunder, the term of office and conditions of service of any person appointed as the Secretary-General of the Society at any time before the commencement of the Indian Red Cross Society (Amendment) Act, 1992 may be varied by the Managing Body with the previous approval of the President.
