Transfer of Property Act, 1882 Section 48

Title: Priority of Rights Created by Transfer

State: Central

Year: 1882

Where a person purports to create by transfer at different times rights in or over the same immoveable property, and such rights cannot all exist or be exercised to their full extent together, each later created right shall, in the absence of a special contract or reservation binding the earlier transferees, be subject to the rights previously created.

Mussalman Wakf Validating Act, 1913 Section 3

Title: Power of Mussalmans to Create Certain Wakfs

State: Central

Year: 1913

It shall be lawful for any person professing the Mussalman faith to create a wakf which in all other respects is in accordance with the provisions of Mussalman law, for the following among other purposes:-- (a) for the maintenance and support wholly or partially of his family, children or descendants, and (b) where the person creating a wakf is a Hanafi Mussalman, also for his own maintenance and support during is lifetime or for the payment of his debts out of the rents and profits of the property dedicated: Provided that the ultimate benefit is in such cases expressly or impliedly reserved for the poor or for any other purpose recognised by the Mussalman law as a religious, pious or charitable purpose of a permanent character.

Title: Liability of Company to Create Security and Debenture Redemption Reserve

.....may, on the application of any or all the holders of debentures shall, after hearing the parties concerned, direct, by order, the company to redeem the debentures forthwith by the payment of principal and interest due thereon. Powers of Attorney Act, 1882 Section 4

Title: Deposit of Original Instruments Creating Powers-of-attorney

.....as a certified copy, and, when so stamped or marked, shall become and be a certified copy. Title: No Mortgage Etc., to Be Created Without Consent of Parties After Execution of Agreement for Sale

No promoter shall, after he executes an agreement to sell any flat, mortgage or create a charge on the flat or the land, without the previous consent in writing of the persons who take or agree to take the flats, and if any such mortgage or charge is made or created without such previous consent after the agreement referred to in section 4 is registered, it shall not affect the right and interest of such persons.

Every company shall cause a copy of every instrument creating any charge requiring registration under this Part to be kept at the registered office of the company: Provided that, in the case of a series of uniform debentures, a copy of one debenture of the series shall be sufficient.

Title: Right to inspect copies of instruments creating charges and company's register of charges
