THE BOMBAY COURT-FEES (AMENDMENT) ACT, 2011 [Act No. 25 of 2011] [10th August, 2011] PREAMBLE An Act further to amend the Bombay Court-fees Act, 1959. WHEREAS both Houses of the State Legislature were not in session; AND WHEREAS the Governor of Maharashtra was satisfied that circumstances existed which rendered it necessary for him to take immediate action further to amend the Bombay Court-fees Act, 1959, for the purposes hereinafter appearing; and, therefore, promulgated the Bombay Court-fees (Amendment) Ordinance, 2011, on the 8th June 2011; AND WHEREAS, it is expedient to replace the said Ordinance by an Act of the State Legislature; It is hereby enacted in the Sixty-second Year of the Republic of India as follows :-

.....Judge/Additional Sessions Judge, nominated by the State Government wither the concurrence of the High Court for the purpose of section 13; (c) "Code" means the code of Criminal Procedure, 1973 (2 of 1974); (d) "Declaration" in relation to an offence, means a declaration made under section-5 in respect of such offence; (e) "Offence" means an offence of criminal misconduct which attracts application of clause (e) of sub-section (1) of section 13 of the Act either independently or in combination with any other provision of the Act or any of the provision of Indian Penal code. (49 of 1988); (f) "Special Court" means a Special Court established under section 3; and (g) Words and expressions used herein and not defined but defined in the code or the Act shall have the meanings respectively assigned to them in the code or the Act. CHAPTER II EXTABLISHMENT OF SPECIAL COURTS 3. Establishment (1) The state Government shall, for the purpose of speedy trial of offence, by notification, establish as many courts as considered adequate to be called Special Courts. Title: Insertion of Section 28b of Act Xiv of 1869

After section 28A of the principal Act, the following section shall be inserted, namely.- "28B. Transfer of pending suits and appeals.- On the commencement of the Bombay Civil Courts (Amendment) Act, 2011 (Mah. XLIV of 2011),- (1) all suits in which the amount or value of the subject matter does not exceed rupees five lakhs and which are pending before the Court of Civil Judge (Senior Division), immediately, before such commencement, shall stand transferred to the concerned Court of Civil Judge (Junior Division) and such court may deal with such suit from the stage which was reached before such transfer or from any earlier stage or de-novo as such court may deem fit; (2) all appeals in which the amount or value of the subject matter does not exceed rupees ten lakhs and pending before the High Court immediately before such commencement, shall stand transferred to the concerned District Court and such District Court may deal with such appeal from the stage which was reached before such transfer or from any earlier stage or de-novo as such court may deem fit: Provided that, this section shall not apply to any suits and appeals which are pending before the Court of Civil.....

Title: Amendment of Section 42 of Bom. Xxxvi of 1959

To section 42 of the principal Act, the following proviso shall be added, namely :-- "Provided that, where court-fee is paid by e-payment, the officer competent to cancel stamp shall verify the genuineness of the payment and after satisfying himself that the court-fee is paid, shall lock the entry in the computer and make an endorsement under his signature on the document that the court-fee is paid and the entry is locked."
