THE SIKKIM PUBLIC WORKS (LIABILITY OF GOVERNMENT & CONTRACTOR) ACT, 1983 THE SIKKIM PUBLIC WORKS (LIABILITY OF GOVERNMENT & CONTRACTOR) ACT, 1983 (ACT NO. II OF 1983) [1.10.83] AN ACT to provide for liability of the Government and the contractor for certain damage caused to the property in the course of executing a public work and for matters connected therewith. Be it enacted by the Legislature of Sikkim in the Thirty-fourth Year of the Republic of India as follows: Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Public Works (Liability of Government and Contractor) Act, 1983. (2) It extends to the whole of Sikkim. (3) It shall come into force on such date as the State Government may, by notification, appoint. Definition. 2. In this Act, unless the context otherwise requires, (I) "avoidable damage" means cutting of trees, standing crops, damage to huts, camping or dumping materials on the land of another person .without the authority of the owner of the said land and includes any other damage which, in the opinion of the Government, is not an unavoidable damage; 3. (2) Chief Engineer" means an officer of the Government.....

Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 Section 10E

Title: Recovery of Monies by Employers and Contractors

.....may be recovered by such employer from the contractor either by deduction from any amount payable to the contractor under any contract or as a debt payable by the contractor. (2) A contractor from whom the amounts mentioned in sub-section (1) may be recovered in respect of any employee employed by or through him may, save as otherwise provided in the Coal Mines Provident Fund Scheme, recover from such employee the employee's contribution under any such Scheme by deduction from the wages payable to the employee subject to the condition that no such deduction shall be made from any wages other than such as are payble in respect of the period to which the employee's contribution relates. (3) Notwithstanding any contract to the contrary, no contractor shall be entiitled to deduct the employer's contribution or the charges or bonus referred to in sub-section (I) from the amount payable to an employee employed by or through him or otherwise to recover such contibulion or charges or bonus from such employee. ________________________ 1. Karnataka Municipalities Act, 1964 Section 207

Title: Works to Be Done by Licensed Plumber or Licensed Water Supply Contractor

.....when so required furnish to the Municipal Commissioner or Chief Officer the name of such plumber or contractor. (3) When any work is executed except in accordance with the provisions of sub-section (1), such work shall be liable to be dismantled by the municipal council without prejudice to the right of the council to prosecute under this Act the person at whose instance such work has been executed. (4) If any licensed plumber or licensed water supply contractor contravenes any bye-law made under clause (cc) of sub-section (1) of section 324 or of the conditions of his licence, his licence may be suspended or cancelled whether he is prosecuted under this Act or not. (5) Whoever contravenes the provisions of sub-section (1) or (2), shallbe punished with fine which may extend to twenty-five rupees.

Personal Injuries (Compensation Insurance) Act, 1963 Section 10

.....or business of the principal (either such other person being in this Section referred to as the contractor) the principal shall obtain from the contractor the name of the agent of the Central Government acting under Section. 11 with whom he intends to insure, and shall report to the agent the existence of his agreement or contract with the contractor. (2) Notwithstanding anything elsewhere contained in this Act, in any such case as is referred to in sub-Section (1), it shall not be necessary for the contractor to insure against the liabilities imposed on him by this Act in respect of workmen employed by him whose services are lent or let on hire on such an arrangement or used in the execution of work on such a contract as is referred to in sub-Section (1), where the arrangement or contract is for a term of less than one month. (3) The Scheme may make provision for supply by a contractor to a principal of any information necessary to enable the purposes of this Section to be carried out including provision for punishment by fine not exceeding two thousand rupees for the contravention of any requirement of the Scheme.

Inter-state Migrant Workmen (Regulation of and Conditions of Service) Act, 1979 Chapter III

.....shall, on the basis of the number of workmen employed, the wages payable to them, the facilities which shall be afforded to them and other relevant factors provide for the norms with reference to which such security may be determined. Section 9 - Grant of licences (1) Every application for the grant of a licence under sub-section (1) of section 8 shall be made in the prescribed form and shall contain the particulars regarding the location of the establishment, the nature of process, operation or work for which inter-State migrant workmen are to be employed and such other particulars as may be prescribed. (2) The licensing officer may make such investigation in respect of the application received under sub-section (1) and in making any such investigation, the licensing officer shall follow such procedure as may be prescribed. (3) A licence granted under section 8, shall be valid for the period specified therein and may be renewed from time to time for such period and on payment of such fees and on such conditions as may be prescribed. Inter-state Migrant Workmen (Regulation of and Conditions of Service) Act, 1979 Chapter IV

Title: Duties and Obligations of Contractors

.....every inter-State migrant workman who ceases to be employed, a return in such form and in such manner as may be prescribed, to the specified authority in the State from which he is recruited and in the State in which he is employed, which shall include a declaration that all the wages and other dues payable to the workman and the fare for the return journey back to his State have been paid. (2) The contractor shall maintain the pass book referred to in sub-section (I) up-to-date and cause it to be retained with the inter-State migrant workman concerned. Explanation.--For the purposes of this section and section 16 "specified authority" means such authority as may be specified by the appropriate Government in this behalf.
