Notwithstanding anything contained in any judgement, decree or order of any court or other authority having regard to the serious handicap suffered by rural candidates who have studied in rural schools as compared to those who have studied in urban schools and the inadequate representation of rural candidates in the civil services of the State, twenty-five percent of the vacancies earmarked for direct recruitment in each of the categories of General Merit, the Scheduled Castes and Schedule Tribes and in each of the categories of the Other Backward Classes shall be reserved for rural candidates: Provided that in the case of a rural candidate belonging to general merit or the other backward classes except category I, concept of creamy layer as may be applicable as per the orders of the Government with regard to reservation issued under clause (4) of Article 16 of the Constitution shall apply mutatis mutandis.

Title: Continuance of Certain Emergency Provisions

(1) Notwithstanding the expiry of the Defence of India Act, 1939, and the Emergency Provisions (Continuance) Ordiance, 1946 (a) the provisions of the Defence of India Rules mentioned in the first column of the Schedule to this Act shall continue in force, and shall have effect subject to the modifications specified in the second column thereof; (b) any order or other instrument made or deemed to be made under or in pursuance of any of the said provisions and in force immediately before the commencement of this Act shall continue in force so far as consistent with the provisions as continued in force by this section and be deemed to be made under or in pursuance of the provisions so continued in force. (2) The references in sub-section (1) to the Defence of India Rules shall be construed as references to those Rules as modified and continued in force by the Emergency Provisions (Continuance) Ordiance, 1946.
