.....settle the form of and bring together in one Act, many detailed provisions which commonly appeared in special Acts authorising various kinds of public undertakings, such as the construction of railways. Thereafter the provisions of the Appropriate Clauses Act could be incorporated by reference in subsequent special Acts, thereby promoting uniformity and consistency and shortening and simplifying the special Acts. Some Clauses Acts are deemed incorporated in later special Acts unless varied on excluded thereby; others apply only in so far as expressly incorporated".-The Oxford Companion to Law, David M. Title: Continuation of Orders, Etc., Issued Under Enactments Repealed and Re

.....by a Bombay Act 1[or Maharashtra Act] with or without modification, then, unless it is otherwise expressly provided, any appointment, notification, order, scheme, rule, by-law or form made or issued under the repealed enactment shall, so far as it is not inconsistent with the provisions re-enacted, continue in force, and be deemed to have been made or issued under the provisions so re-enacted, unless and until it is superseded by any appointment, notification, order, scheme, rule, by-law or form made or issued under the provisions so re-enacted. NOTES Repealed Notification.-It was held that the Notification even if it continued in force because of the application of section 25 of the Bombay General Clauses Act, 1904, extended the ordinance and not the Act. In the result, the connection made by the State that the Act had been extended to areas other than those mentioned in section 15 of the Bombay Building (Control of Erection) Act, 1948 to the extent that cinema theatres are concerned fail, because the Notification cannot lend any support whatever to it.- State of Bombay v. Title: Continuation of Orders, Etc., Issued Under Enactments Repealed and Re-enacted

Title: Continuance of Certain Emergency Provisions

(1) Notwithstanding the expiry of the Defence of India Act, 1939, and the Emergency Provisions (Continuance) Ordiance, 1946 (a) the provisions of the Defence of India Rules mentioned in the first column of the Schedule to this Act shall continue in force, and shall have effect subject to the modifications specified in the second column thereof; (b) any order or other instrument made or deemed to be made under or in pursuance of any of the said provisions and in force immediately before the commencement of this Act shall continue in force so far as consistent with the provisions as continued in force by this section and be deemed to be made under or in pursuance of the provisions so continued in force. (2) The references in sub-section (1) to the Defence of India Rules shall be construed as references to those Rules as modified and continued in force by the Emergency Provisions (Continuance) Ordiance, 1946.

Any legal proceedings which, immediately before the appointed day,-- (a) were pending by or against the Secretary of State in any Court within the territories which as from the appointed day became the territories of India by virtue of subsection (1) of section 2 of the Indian Independence Act, 1947, 10 and 11 Geo.6, c.30.and (b) were in respect of any right of India or any part of India, shall-- (i) if the right in question was that of the Governor-General in Council be continued by or against the Dominion of India; (ii) if the right in question was that of the former Province of Bengal or the Punjab, be continued by or against the Province of West Bengal or East Punjab, as the case may be; and (iii) if the right in question was that of any Governor's Province other than Bengal, the Punjab, the North-West Frontier Province or Sind, be continued by or against that Province.
