INDIA (CONSEQUENTIAL PROVISION) ACT, 1949 [Act, No. 12 of 1949] [16th December, 1949] PREAMBLE An Act to make provision as to the operation of the law in relation to India, and persons and things in any way belonging to or connected with India, in view of India's becoming a Republic while remaining a member of the Commonwealth. WHEREAS on the twenty-sixth day of January, nineteen hundred and fifty, India is to become a Republic while remaining a member of Commonwealth. BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows: -

India (Consequential Provision) Act, 1949 Complete Act

.....view of India's becoming a Republic while remaining a member of the Commonwealth, and sub-section (1) of this section shall have effect in relation to any such law as modified by such an Order save in so far as the contrary intention appears in the order. An Order in Council under this section- (a) may be made either before or after India becomes a Republic and may be revoked or varied by a subsequent Order in Council; and (b) shall be subject to annulment in pursuance of a resolution of either House of Parliament. (4) Any increase attributable to an Order in Council under this section .in sums payable out of moneys provided by Parliament or out of the Consolidated Fund of the United Kingdom or the growing produce thereof shall be defrayed out of moneys so provided, or out of that Fund or the growing produce thereof, as the case may be. Central Excise Tariff Act, 1985 Section 4

Title: Consequential Amendments of and Construction of References

.....1944, (a) for the words "First Schedule", wherever they occur, the words and figures "Schedule to the Central Excise Tariff Act, 1985" shall be substituted; (b) in section 2, for clause (f), the following clause shall be substituted; namely :- '(f) "manufacture" includes any process,- (i) incidental or ancillary to the completion of a manufactured product; and (ii) which is specified in relation to any goods in the Section or Chapter Notes of the Schedule to the Central Excise Tariff Act, 1985 as amounting to manufacture, and the word "manufacturer" shall be construed accordingly and shall include not only a person who employs hired labour in the production or manufacture of excisable goods, but also any person who engages in their production or manufacture on his own account;' (c) the First Schedule shall be omitted. (2) Any reference to the expression "First Schedule to the Central Excise Act, 1944 (1 of 1944)" in any Central Act shall, on and after the commencement of this Act, be construed as a reference to the Schedule to this Act.

.....shall be made in the Income-tax Act, namely :- (a) in section 45, the figures and letter ",54C" shall be omitted; (b) in clause (iv) of sub-section (2) of section 141A, for the words, brackets and figures "the deduction referred to in clause (ii) of sub-section (2) of section 33", the words, brackets, figures and letter "the deduction referred to in clause (ii) of sub-section (3) of section 32A or clause (ii) of sub-section (2) of section 33" shall be substituted; (c) in sub-clause (iv) of clause (b) of sub-section (1) of section 143, for the words, brackets and figures "the deduction referred to in clause (ii) of sub-section (2) of section 33", the words, brackets, figures and letter "the deduction referred to in clause (ii) of sub-section (3) of section 32A or clause (ii) of sub-section (2) of section 33" shall be substituted; (d) in clause (i) of sub-section (1) of section 160, the words, brackets and figure "clause (i) of" shall be omitted with effect from the 1st day of June, 1976; (e) in the Ninth Schedule, for the brackets, words and figures "[See section 32(1)(vi)]", the brackets, words, figures and letters "[See section 32(1)(vi) and section.....

THE BRITISH STATUTES (REPEAL) ACT, 2004 [Act, No. 17 of 2004] [20th February, 2004] PREAMBLE An Act to repeal the British Law Ascertainment Act, 1859, the Foreign Law Ascertainment Act, 1861, the Colonial Probates Act, 1892, in so far as they apply to India, and the India (Consequential Provision) Act, 1949. Be it enacted by Parliament in the Fifty-fifth Year of the Republic of India as follows:-- 1. Short title This Act may be called the British Statutes (Repeal) Act, 2004. 2. Definition In this Act, "British Statutes" means the British Law Ascertainment Act, 1859, the Foreign Law, Ascertainment Act, 1861, the Colonial Probates Act, 1892, in so far as they apply to India, and the India "(Consequential Provision) Act, 1949. 3. Repeal The British Statutes are hereby repealed.
