Be it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows: CHAPTER I PRELIMINARY Short title, extent and commencement. 1. (1) This Act may be called the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015. (2) It extends to the whole of India except the State of Jammu and Kashmir. (3) It shall be deemed to have come into force on the 23rd day of October, 2015. Definitions. 2. The Sikkim Shops and Commercial Establishments Act, 1983 Complete Act

.....declare to be an establishment for the purposes of this Act; (9) "factory" means any premises which is a factory within the meaning of the Factories Act, 1948 or which is deemed to be a factory under section 85 of the said Act; (10) "goods" includes all materials, commodities and articles; (11) "holiday" means a day on which an establishment shall remain closed or on which an employee shall be given holiday under the provisions of this Act; (12) "Inspector" means an Inspector appointed under this Act; (13) "leave" meansleave as provided for in Chapter VIII of this Act; (14) "local area" means any area or combination of areas to which this Act applies; (I5) "local authority" means the Gangtok Municipal Corporation constituted under the Gangtok Municipal Corporation Act, 1975, and includes any other body which the State Government may, by notification, declare to be local authority for the purposes of this Act; (16) "manager" means a person declared to be a manager under section 6; (17) "member of the family of an employer" means the husband, wife, son, daughter, father, mother, brother, sister of an employer who lives with and is dependent' on such.....

.....In these rules, unless, the context otherwise requires,- (a) "Act" means the Punjab Commercial Crops Cess Act, 1974; (b) "section" means a section of the Act. of proviso 2 to section 3(1) and section 11(2) (a). 3. Determination of Kharaba - Kharaba, for purposes this Act shall be determined in the following manner:- When any commercial crop fails to germinate or dries up or is destroyed by any calamity or fruit trees in an orchard do not bear fruit or the fruit thereof is damaged or destroyed by any calamity so that the total yield in respect of an orchard or a commercial crop as the case may be, is not more than twenty-five percentum of the average yield, the whole of the land under commercial crop or that orchard shall be considered as kharaba. Explanation- (1) Where two or more distinct crops are grown separately in different portions of one khasra number, the aforesaid procedure shall be applied separately to each of such distinct crop. (2) Average yield shall be considered that yield as is determined by the Assessing Authority on the basis of yield in the last three years harvest in that area. .....discharged or dismissed whose claims have not been settled in accordance with this Act, and persons employed in any factory but not governed by the Factories Act, 1948 (Central Act 63 of 1948); (vii) "employer" means a person having charge of or owning or having ultimate control over the affairs of an establishment and includes members of the family of an employer a manager, agent or other person acting in the general management or control of the establishment; (viii)"establishment" means a shop or commercial establishment; (ix) "factory" has the meaning assigned to it in the Factories Act, 1948 (Central Act 63 of 1948); (x) "family" in relation to an employer, means,- (i) spouse, (ii) children and step-children; and (iii) parents, sisters and brothers if residing with and wholly dependent upon him; (xi) "festival" means any festival which the Government may, by notification declare to be a festival for the purpose of this Act; (xii) "Government" means Administrator of the Union territory of Himachal Pradesh appointed by the President under article 239 of the Constitution of India; (xiii) "hours of work" or "working hours" means the time during which the persons employed are at.....
