Chit Funds Act, 1982 Chapter II

Title: Registration of Chits, Commencement and Conduct of Chit Business

.....of the Companies (Amendment) Act, 1965 (31 of 1965), in relation to any of the objects staled in its memorandum in pursuance of clause (c) of sub-section (1) of section 13; (b) if such company, is a company formed after such commencement in relation to any of the objects stated in its memorandum in pursuance of sub-clause (ii) of clause (d) of sub-section (1) of the said section, unless- (i) the company has approved of the commencement of any such business by a special resolution passed in that behalf by its general meeting; and (ii) there has been filed with the Registrar a duty verified declaration by1[one of the directors or the secretary or where the company has not appointed a secretary, a secretary in whole time practice] in the prescribed form, that clause (i) or as the case may be, sub-section (2B) has been complied with; and if the company commences any such business in contravention of this sub-section, every person who is responsible for the contravention shall, without prejudice to any other liability, be punishable with fine which may extend to3[five thousand rupees] for every day during which the contravention continues. Title: Special Provision as to Restarting Undertakings Closed Down Before Commencement of the Industrial Disputes (Amendment) Act, 1976

.....Notwithstanding anything contained in sub-section (1) the appropriate Government may, either on its own motion or on the application made by the employer and after giving the employer and the workmen an opportunity of being heard, review its order under sub-section (1) or refer the matter to a Tribunal for adjudication: Provided that where a reference has been made to a Tribunal under this subsection, it shall pass an award within a period of sixty days from the date of such reference and, pending such award, the undertaking shall not be closed down." ________________________ 1. Colonial Courts of Admiralty Act, 1890 Section 16

.....Act. (3) If, on the commencement of this Act in any British possession, rules of Court have not been approved by Her Majesty in pursuance of this Act, the rules in force at such commencement under the Vice-Admiralty Courts Act, 1863, and in India the rules in force at such commencement regulating the respective Vice-Admiralty Courts or Courts of Admiralty in India, including any rules made with reference to proceedings instituted on behalf of Her Majesty's ships, shall, so far as applicable, have effect in the Colonial Courts or Courts of Admiralty of such possession, and in any Vice-Admiralty Court established under this Act in that possession, as rules of Court under this Act, and may be revoked and varied accordingly; and all fees payable under such rules may be taken in such manner as the Colonial Court may direct, so however that the amount of each such fee shall so nearly as practicable be paid to the same officer or person who but for the passing of this Act would have been entitled to receive the same in respect of like business. So far as any such rules are inapplicable or do not extend, the rules of Court for the exercise by a Court of its ordinary civil jurisdiction.....

Title: Commencement of Winding Up by Tribunal

Commencement of winding up 1[441. Commencement of winding up by Tribunal ( 1 ) Where, before the presentation of a petition for the winding up of a company by the Tribunal, a resolution has been passed by the company for voluntary winding up, the winding up of the company shall be deemed to have commenced at the time of the passing of the resolution, and unless the Tribunal, on proof of fraud or mistake, thinks fit to direct otherwise, all proceedings taken in the voluntary winding up sh all be deemed to have been validly taken. ( 2 ) In any other case, the winding up of a company by the Tribunal shall be deemed to commence at the time of the presentation of the petition for the winding up. ] ____________________ 1. Chit Funds Act, 1982 Section 8

Title: Minimum Capital Requirements for the Commencement, Etc., of a Chit, and Creation of a Reserve Fund, by a Company

(1) Notwithstanding anything contained in the Companies Act, 1956 (1 of 1956), but subject to the provisions of this Act, a company shall not commence or carry on chit business unless it has a paid-up capital of not less than rupees one lakh. (2) Every company having a paid-up capital of less than rupees one lakh and carrying on chit business on the commencement of this Act, shall, before the expiry of a period of three years from such commencement, increase its paid-up capital to not less than rupees one lakh: Provided that the State Government may, if it considers it necessary in the public interest or for avoiding any hardship, extend the said period of three years in respect of any company by such further period or periods not exceeding two years in the aggregate: Provided further that no such company shall commence any new chit the duration of which would extend beyond the said period of three years or such extended period or periods under the first proviso unless it increases its paid-up capital to not less than rupees one lakh. (3) Every company carrying on chit business shall create and maintain a reserve fund and shall, out of the balance of profit of each year.....
