With effect from the appointed day the Central Road Fund governed by the Parliamentary Resolution dated the 13th May, 1988 (hereafter referred to in this section as the existing Fund) shall be deemed to be the Fund established under this Act and,-- (a) all schemes relating to development and maintenance of national highways and Slate roads sanctioned under the existing Fund in so far as such schemes are relatable to the schemes under this Act, shall be deemed to be the schemes sanctioned under this Act; (b) all funds accrued under the existing Fund including assets and liabilities shall be transferred to the Fund established under this Act.

BE it enacted by Parliament in the Seventh Year of the Republic of India as follows:-- _____________________________ 1. The Act has been extended to Goa, Daman and Diu (with modifications) by Reg. 12 of 1962, section 3 and Sch., to Kohima and Mokokchung districts of Nagaland (as in force on 5-8-1971) by Act 61 of 1972, section 14 (1) w.e.f. 30-11-1972. The amendments made to the Act 61 of 1972, came into force in the said districts w.e.f. 1-4-1973 vide section 14(2), Act 61 of 1972.

The Central Government may, by notification in the Official Gazette, declare that any of the provisions of the1[ Customs Act, 1962 (52 of 1962)] relating to the levy of and exemption from customs duties, drawback of duty, warehousing, offences and penalties, confiscation, and procedure relating to offences and appeals shall, with such modifications and alterations as it may consider necessary or desirable to adapt them to the circumstances, be applicable in regard to like matters in respect of the duties imposed by section 3. ______________________ 1. Title: Vexatious Search, Seizure, Etc., by Central Excise Officer

Any Central Excise or other Officer exercising powers under this Act or under the rules made thereunder who-- (a) without reasonable ground of suspicion searches or causes to be searched any house, boat or place; (b) vexatiously and unnecessarily detains, searches or arrests any person; (c) vexatiously and unnecessarily seizes the movable property of any person, on pretence of seizing or searching for any article liable to confiscation under this Act; (d) commits, as such officer, any other act to the injury of any person, without having reason to believe that such act is required for the execution of his duty; shall, for every such offence, be punishable, with fine which may extend to two thousand rupees. Any person wilfully and maliciously giving false information and so causing an arrest or, a search to be made under this Act shall be punishable with fine which may extend to two thousand rupees or with imprisonment for a term which may extend to two years or with both.
