THE CANTONMENTS ACT, 1924 [Act, No. 2 of 1924]1 [16th February, 1924] PREAMBLE An Act to consolidate and amend the law relating to the administration of cantonments. whereas it is expedient to consolidate and amend the law relating to the administration of cantonments, it is hereby enacted as follows :-- ________________________ 1. For Statement of Objects and Reasons, see Gazette of India 1923, Pt. V, p. 220 and for Report by the Select Committee, see Gazette of India, 1923, Pt. V, pg. 270. The Act came into force in Pondicherry on 1-10-1963, vide Reg. 7 of 1963, section 3 and Schedule I.

Title : The Cantonment Laws (Extension and Amendment Act, 1950

.....by Parliament as follows: -- 1 . Short title This Act may be called the Cantonments Laws (Extension and Amendment) Act, 1950. 2 . Amendment of section 1, Act VI of 1923 In sub-section (2) of section 1 of the Cantonments (House Accommodation) Act, 1923, the words and letter "except Part B States" shall be omitted. 3 . Amendment of section 2, Act VI of 1923 To section 2 of the Cantonments (House Accommodation) Act, 1923, the following sub-section shall be added, namely: -- "(2) In the application of this Act to any Part B State, any reference to an enactment not in force in that State shall be construed as a reference to the corresponding law in force in that State." 4 . Amendment of section 1, Act II of 1924 In sub-section (2) of section 1 of the Cantonments Act, 1924 (hereinafter referred to as the said Act), the words and letter "except Part B States" shall be omitted. 5 . Insertion of new section 2A in Act II of 1924 After section 2 of the said Act, the following section shall be inserted, namely: "2A.Rule of construction.- In the application of this Act to any Part B State, any reference to an enactment not in force in that State shall be construed as a.....

Title : Recovery from a Person About to Leave Cantonment

(1) If the Executive Officer has reason to believe that any person from whom any sum is due1[or is about to become due] on account of any tax is about to2[move from the cantonment], he may direct the immediate payment by such person of the sum so due or about to become due, and cause3[a notice of demand] for the same to be served on such person. 4[(2) If, on the service of such notice, such person does not forthwith pay the sum so due or about to become due, the amount shall be leviable by distress and sale of movable property or attachment and sale of immovable property in the manner hereinbefore provided in this Chapter, and the warrant of such distress and sale or attachment and sale may be issued and executed without any delay.] ________________________ 1. Title : Disposal of Cantonment Fund when Area Ceases to Be a Cantonment

(1) When, by a notification under section 3, any cantonment ceases to be a cantonment and the local area comprised therein is immediately placed under the control of a local authority, the balance of the cantonment fund and other property vesting in the1[Board] shall vest in such local authority, and the liabilities of the1[Board] shall be transferred to such local authority. (2) When, in like manner, any cantonment ceases to be a cantonment and the local area comprised therein is not immediately placed under the control of a local authority, the balance of the cantonment fund and other property vesting in the1[Board] shall vest in Government, and the liabilities of the1[Board] shall be transferred to the2[the Central Government]. __________________________ 1. Title : Extension of Certain Provisions of the Act and Rules to Place Beyond Cantonments

The1[Central Government) may, by notification in the Official Gazette, and subject to any conditions as to compensation or otherwise which it thinks fit to impose, extend to any area beyond a cantonment and in the vicinity thereof, with or without restriction or modification, any of the provisions of Chapters IX, X, XI, XII, XIII, XIV and XV or of any rule or bye-law made under this Act for the cantonment which relates to the subject-matter of any of those Chapters, and every enactment, rule or bye-law so extended shall thereupon apply to that area as if the area were included in the cantonment. _____________________________ 1.
